Abstract
In 2017, German legislator established the Act on improving law enforcement in social networks(NetzDG). That act is designed to ensure transparency in the process of posting illegal online content such as fake news, hate crimes and child pornography contrary to criminal code. Through the clear and transparent procedure to handle online contents, it aims to establish a system that allow all users to share sound and sufficient information from internet service like SNS or portal, while preventing user’s right from illegal or right infringing online posts. Procedural guarantee of self regulatory authority can fill the gap of the public regulation by the government considering the characteristics of internet service. Moreover, the law imposes an obligation to foreign social network service provider such as facebook, twitter to assign a domestic proxy in order to secure not discriminating between inland and foreign undertaking for imposing the duty of supplying for the adequate process of handling internet content and reporting to the jurisdictional authority. Current legal situation in Korea, protecting users right both uproader and victim through the defamation-like online content is insufficient because the legal standard for processing on treating online content by internet service provider is lack of obviousness, especially arbitrary interim measure. German NetzDG gives us some implication. Firstly, in order to specify the requirements of illegal contents, it is necessary to link them with the provisions of the Criminal Code or the special criminal statute. Second, all illegal or right infringing postings should be treated after reporting or requesting from an user or a third party who claims damages. To protect the users, legislator and government shall give a clear guidelines for ISP to provide the procedure for handling online postings, the standard whether and when he erases, hides or restores it like NetzDG. They also should provide non-discriminating statutory online duty for domestic and foreign undertakings.
