미국의 가석방 불가 종신형에 관한 비판적 고찰

A Critical Review on Life Without Parole(LWOP) in U.S.

초록

가석방 불가 종신형은 삶의 마지막 순간까지 엄격한 관리ㆍ감독하에 교도소 내의 제한된 생활만이 허용된 가혹한 형벌형태이다. 사회로의 복귀는 불가하며, 이로 인하여 대부분의 수형자는 좌절감, 우울감, 외로움과 같은 정신적 고통을 겪는다. 사회적 존재로서 자아 또한 상실된다. 그럼에도 불구하고 미국에서는 1970년대부터 시작된 엄벌주의 정책과 사형폐지의 흐름에 힘입어 가석방 불가 종신형의 지위는 날로 높아지고 있다. 2021년 현재 알래스카 주를 제외한 모든 주와 연방이 가석방 불가 종신형 제도를 운영하며 총 55,945명이 수형 중에 있다. 다시 자유를 향유할 기회를 박탈한다는 점에서 가석방 불가 종신형은 인권침해와 위헌성 논란으로부터 자유로울 수 없다. 가석방 불가 종신형 제도의 폭넓은 적용범위와 형벌의 엄중성과 달리 사법절차상의 권리보호도 미흡하다. 또한 형벌수단으로서 범죄예방 및 재사회화의 기능 수행에도 의문이 제기되며, 교도소의 과밀화와 교정비용 상승 문제도 가석방 불가 종신형 제도 운영의 부담으로 작용하고 있다. 응보와 처벌의 법감정을 넘어서 가석방 불가 종신형 제도의 정당성 및 합리성에 관한 비판적 성찰이 요청되는 바이다.

Abstract

Life without parole is the sentence of life in prison without the possibility of parole. In 2021, all states and federal government except Alaska have operated the life without parole and 55,945 people are serving LWOP. Since 1970, the number of people serving LWOP has increased rapidly due to tough—in-crime policy and abolition of the death penalty. Offenders are sentenced to spend the whole remainder of their natural lives in high-stress prison and suffer from mental health like lethargy, loneliness, dementia. Prisoners are separated from his family and lose their social self. LWOP sentences foreclose the right to hope all prisoners should have and undermine the human diginity. There is no hope for redemption or reform. Also, LWOP sentences are not afforded the heightened due process protections and don’t work well with detterence and rehabilitation. Lastly, it makes the overcrowding correctional institution and the greater cost comes from expensive living condition. Thus, this article argues for the critical aspects of the LWOP and reassess the justification and validity of the LWOP.
