호주의 양육비 이행확보를 위한 제도- 우리의 양육비 법제 개선을 위한 시사점 -

미성년 자녀가 건강하게 성장하고 발전할 수 있도록 의식주 및 교육, 건강 돌봄 등을 제공하여야 하는 부모의 의무는 절대적으로 인정되고, 이러한 의무는 부모의 혼인 여부에 관계없이 이행되어야 한다. 그러나 이혼 등으로 부모 일방만이 자녀를 양육하는 경우, 부모의 협의나 법원의 결정에 의하여 양육비 부담자와 금액이 정해지더라도 이행되지 않는 경우가 많아 사회의 문제로 부각되어 왔다. 이에 대한 사법적ㆍ정책적 노력에도 불구하고 여전히 실효성이 확보되지 않자, 최근 여성가족부가 양육비 채무자의 동의 없이 소득ㆍ재산조회가 가능하도록 하고, 양육비 채무불이행자에 대해 감치명령과 별개로 이행명령 결정 후 형사처벌 등 제재조치가 가능하도록 하는 ‘양육비이행법’ 개정을 추진하겠다고 밝혔다. 호주의 양육비 제도는 양육비 대지급제도가 없는 점 및 양육비 이행확보 지원기구가 설치되어 있는 점에서는 우리와 같으나, 양육비 이행확보 지원기구가 양육비 결정부터 이행지원까지 담당하는 점에서 차이가 있다. 시사점을 정리해보면, 호주는 양육비 등록관에 의한 양육비의 산정과 추심을 통한 양육비 등록절차가 가족수당 지급과 연동하도록 설계되어 양육비의 산정과 등록이 간접적으로 강제된다. 등록된 양육비는 등록관에 의한 직접추심이 가능하여 그 이행이 확보되고 불이행 현황을 파악할 수 있으며, 이를 위하여 등록관이 양육비의 산정 및 등록, 추심에 필요한 정보를 수집하고, 양육비 이행 절차에 필요한 다른 기관의 정보에 접근 및 활용할 수 있는 권한이 있어 양육비의 결정부터 이행확보까지 체계적으로 이루어질 수 있다.
Abstract
The obligation of parents to maintain their minor children is absolute and this obligation must be fulfilled regardless of whether the parents are married. However, many parents fail to fulfill this obligation, and it has been a social problem. The Korean Ministry of Women and Family Affairs has recently proposed legislative changes to strengthen child support enforcement. Australia's child support system is similar to ours in that it does not have a guaranteed child support and has a child support agency, but it differs in that the agency is in charge of the whole process in child support enforcement. Australia's child support system is designed to link the calculation and collection of child support by the child support registrar to the payment of family benefits, thus indirectly enforcing the registration of child support. Registered child support can be directly collected by the registrar to ensure enforcement and identify defaults, and to this end, the registrar is authorized to collect information necessary for the calculation, registration, and collection of child support and to access and utilize information from other agencies necessary for the child support enforcement process, so that the process from determination of child support to enforcement can be systematic.
