민간 구조 선박에 대한 항만국 통제 - Sea Watch 사건을 중심으로 -

수색 및 구조(SAR)에 관한 국제협약이나 기타 국제 규정들은 해상에서 수색 및 구조 활동에 참여하는 선박에 대한 구체적인 요건을 정하고 있지 않다. 지중해에서 조난당한 이주민 구조를 목적으로 하는 민간 구조 선박에 대한 분류 규정과 안전 요건 규정이 국제법 체계에 부재하므로, 유엔해양법협약, SOLAS 협약 및 SAR 협약 등에 명시된 구조 체계에 의존해야 하는 상황이다. EU는 수색 및 구조 활동을 목적으로 하는 NGO가 운영하는 민간 구조 선박이 SAR 활동과 관련된 안전 및 보건 요건 등이 충족되도록 등록하고 장비하는 것이 공공 정책의 문제라고 본다. 이탈리아 항만 당국은 항만국 통제에 관한 유럽 지침 2009/16/EC를 적용하여 지중해에서 수색 및 구조를 수행하는 NGO 구조선 다수를 검사하고 억류하였다. Sea Watch 사건이 대표적 사례이다. 그러나 민간 구조선에 대한 항만국 통제의 이러한 자의적 적용이 정당한지에는 의문이 있다. 조난자 구조와 관련한 특정 안전 요건을 규정하는 국가 법률 조항이 해상에서 조난당한 사람을 지원해야 하는 국제법상 선장의 의무를 제한할 수 없다. 항만국은 기국이 부여한 인증 및 분류체계를 존중하는 등 항만국의 권한 범위를 준수해야 하고, 해상에서 조난당한 사람을 지원하는 민간 구조선 선장의 구조 의무도 존중해야 할 것이다.

Abstract

International Convention on Search and Rescue (SAR) and other international regulations do not establish specific requirements for vessels engaged in search and rescue activities at sea. In the absence of provisions in the international legal framework of classification and safety requirements for private rescue vessels engaged in the rescue of migrants in distress in the Mediterranean Sea, it is necessary to rely on the rescue regimes set out in the UN Convention on the Law of the Sea, the SOLAS Convention and the SAR Convention. The EU considers it a matter of public policy to ensure that civilian rescue vessels operated by NGO for the purpose of search and rescue activities are registered and equipped to meet the safety and health requirements associated with SAR activities. Italian port authorities have applied the provisions of Directive 2009/16/EC on Port State Control to inspect and detain rescue vessels of NGOs engaged search and rescue in the Mediterranean sea. The Sea Watch case is a prime example. However, it is questionable whether the application of port state control to civilian rescue vessels is justified. Provisions of national legislation stipulating certain safety requirements for the rescue of persons in distress cannot limit the obligation of a ship master under international law to assist persons in distress at sea. The port state would have to comply with the scope of its authority, respecting the certifications and classification schemes granted by the flag state, and would also have to respect the rescue obligation of the master of civilian rescue vessel to assist persons in distress at sea for safety reasons.
