금융데이터거래소의 활성화 방안을 모색하기 위한 목적의 본 논문에서는 먼저 금융데이터와 금융거래소의 의의에 대해서 살펴보았다. 금융산업 및 금융과 관련된 데이터인 금융데이터는 활용가치와 잠재된 경제적 가치가 매우 높고 다른 데이터와의 시너지 높은 시너지 효과도 기대되는 양질의 자원이라고 할 수 있다. 한편 금융과 관련한 데이터를 거래하는 시장 내지 플랫폼으로 정의할 수 있는 금융데이터거래소는 국가의 핵심 경쟁력이자 국부의 원천이 되고 있는 금융데이터를 가장 효율적으로 지원할 수 있는 시스템으로서 앞으로 그 중요성이 기대되고 있다. 금융데이터가 유료로 거래되는 플랫폼뿐만 아니라 금융데이터를 무료로 개방하는 플랫폼도 광의의 금융데이터거래소에 해당하는 것으로 볼 수 있는데 현재 국내에는 금융보안원의 FinDX, 한국데이터산업진흥원의 데이터스토어, 금융 빅데이터 플랫폼, KDX 한국데이터거래소 등 다양한 금융데이터거래소가 운영되고 있으며, 이외에도 공공영역과 민간영역에 걸쳐 다수의 금융데이터거래소가 존재한다. 현재 국내 금융데이터거래소는 거래소에 대한 별도의 자격없이 「전자상거래 등에서의 소비자 보호에 관한 법률」상 통신판매중개업 신고만 하면 누구나 운영이 가능한 상황이다. 이로 인해 다수의 금융데이터거래소가 난립하고 있으며 이외에도 금융데이터 가격 결정 구조 및 투명성 문제, 금융데이터거래소 이용에 대한 유인책 부재, 금융데이터거래소의 이중적 지위 등의 문제로 인해 금융데이터거래소가 활성화되지 못하고 있는 실정이다. 이와 같은 상황을 개선하기 위한 방안으로서 본 논문에서는 금융데이터거래소의 법적 지위 및 근거에 대한 규정 신설, 금융데이터거래소의 허가제 운영을 위한 규정 신설 등 금융데이터거래소에 대한 법적 근거 마련, 금융데이터에 대한 가치평가 기반 마련, 금융데이터거래소 이용을 위한 유인책 마련 등을 제언하였다.
Abstract
In this paper for the purpose of finding a way to vitalize the financial data exchange, we first looked at the significance of financial data and the financial exchange. Financial data, which is data related to the financial industry and finance, is a high-quality resource that has very high utilization and potential economic value, and a high synergy effect with other data. Meanwhile, the financial data exchange, which can be defined as a market or platform for transacting financial data, is expected to be important in the future as a system that can most efficiently support financial data, which is the country's core competitiveness and source of national wealth. Platforms where financial data are traded for a fee as well as platforms that open financial data for free can be considered as financial data exchanges in a broad sense. Various financial data exchanges such as the data platform and KDX Korea Data Exchange are in operation, and there are also a number of financial data exchanges in the public and private sectors. Currently, the domestic financial data exchange is a situation in which anyone can operate a domestic financial data exchange by just reporting a mail-order brokerage business under the 「Consumer Protection Act in E-Commerce, etc.」 without a separate qualification for an exchange. Due to this, a number of financial data exchanges are inundated. In addition, financial data exchanges are not being activated due to problems such as financial data pricing structure and transparency problems, lack of incentives to use financial data exchanges, and the dual status of financial data exchanges. to be. As a measure to improve this situation, in this paper, the legal basis for the financial data exchange, such as the establishment of regulations on the legal status and basis of the financial data exchange, the establishment of regulations for the operation of the license system of the financial data exchange, and the value of financial data It was suggested to prepare an evaluation basis and prepare incentives for using the financial data exchange.
