최근 프라이버시에 대한 국민의 관심이 높아지고, CCTV 등 감시체제의 확산에 따른 불특정 다수인에 대한 감시 사례가 꾸준히 증가하면서 이러한 감시를 통한 개인정보 보호 문제에 대한 보다 깊은 이론적 관심이 필요하게 되었다. 그런데 이러한 ‘경찰책임자 이외의 자에 대한 감시’를 구체적으로 지목하여 규율하는 법조항이 없어, 이러한 활동의 법적 성격 등에 대하여는 논의가 분분한 상태이다. 본 연구는 미국에서의 「비전통적인 용의자(nontraditional suspect)」 확산 경향과 관련된 감시기술과 프라이버시간 관계를 법률, 판례 등을 중심으로 구체적으로 살펴보고자 한다. 이를 통해 한국경찰의 개인정보 수집체계를 개선하는데 있어 시사점을 찾아보고자 한다.
Abstract
Due to unknown or elusive crime and terrorism threats, law enforcements have extended their net of suspicion to include most members of society, even those once considered beyond reproach. This is evidenced by the ubiquity of official surveillance that monitors the public, and often private, activities of society. No longer is anyone immune from suspicion or scrutiny as police strive to anticipate and thwart the next move of unknown crime and terrorism threats. To say that civil liberty and privacy interests are being affected by official countermeasures and millennial threats is an understatement. Yet, in spite of efforts by government officials, law makers, and courts to strike a satisfactory balance public safety and privacy rights, widespread surveillance has rendered some aspects of individual privacy a casualty of the war on crime and terrorism.
