20세기 '전후보상' 개념의 형성과 변용: 한국과 일본 간의 보상문제를 중심으로

이 연구는 20세기 초에 형성된 전후보상 개념이 제1차 세계대전 이후 동아시아에 전파되고, 제2차 세계대전 이후의 한일관계에서 변용된 역사적 궤적을 다음과 같이 분석하고 있다. 첫째, 20세기 초 헤이그 협약(1907)과 베르사유 평화조약(1919, 232조, 302조)은 민간인에 대한 보상조항과 개인의 청구권에 대한 조항을 통해 전후보상의 개념을 국제적으로 확립했다. 특히 베르사유 평화조약 체결과정에서 일본은 5대 승전국의 일원으로 참여함으로써 전후보상 개념의 동아시아로의 전파를 촉진시켰다. 둘째, 한국이 아시아ㆍ태평양전쟁 이후 일본에 대해 요구했던 보상은 전쟁의 피해에 대한 보상과 더불어 1910년 이후 식민피해에 대한 보상을 포함하는 복합성을 지녔다. 셋째, 1951년 9월 8일에 체결된 샌프란시스코 평화조약은 베르사유 평화조약과는 달리 민간인의 피해에 관한 전후보상 개념을 규정하지 않았다. 베르사유 평화협상 때와 달리 패전국의 보상책임에 대해 관대한 입장을 취했던 것은 베르사유 평화조약의 징벌적 성격이 2차대전의 원인이 되었다는 인식과 더불어 한반도의 6.25 전쟁으로 인해 격화된 냉전의 결과였다. 1965년 한국과 일본 간의 국교정상화로 이어지는 협상과정에서 논의되었던 한일 간의 보상문제는 샌프란시스코 평화조약 제4조에 등장하는 청구권 개념에 의해 구속되었다.
Abstract
This study explores the concept of postwar compensation established in the early 20th century in Europe, and how those ideas were diffused to East Asia and applied between South Korea and Japan. Our conclusions are as follows. First, the Hague Convention(1907) and Versailles Peace Treaty(1919, Art. 232 and 302) established the concept of postwar compensation by stipulating the articles regarding compensation for civilians and rights of individuals to claim compensation. The diffusion of the postwar compensation concept to East Asia was accelerated by Japan's role in the Versailles Peace Conference as one of the so-called Big 5 victorious countries. Second, the compensation South Korea requested from Japan after the Asia-Pacific War was twofold―postwar compensation and colonial compensation. Third, the San Francisco Peace Treaty signed in September 8, 1951 did not stipulate postwar compensation for civilian damages, unlike the provisons of the Versailles Peace Treaty. During the discussion for the San Francisco Peace Treaty, the Allied Powers were hesitant to impose compensation responsibility to Japan due largely to the idea that the punitive nature of the Versailles Peace Treaty contributed to the outbreak of World War Ⅱ. The Cold War aggravated by the Korean War added fodder to this opinion. The concept of "claims against Japan" in the Article 4 of the San Francisco Peace Treaty determined the compensation issue emerged between South Korea and Japan during the negotiation for the diplomatic normalization of two countries which was to be realized in 1965.
