방송법의 보편적 시청권 규제, 문제점과 개선방안

국내에서도 2000년대 초반 다채널이 본격화되면서 스포츠중계권의 폭등이 여러 차례 사회적인 쟁점으로 부각되었다. 이에 국회에서는 2000년대 중반에 방송법 개정을 통하여 보편적 시청권규제를 실시하였다. 하지만, 보편적 시청권 규제는 국민관심행사 목록과 우선방송사의 선정기준이 명확하지 않다. 또한 국민들의 보편적 시청권보다는 과도한 경쟁방지라는 다른 정책수단으로 바뀐 측면이 있다. 월드컵, 올림픽과 같은 지구적, 국민적 스포츠축제는 특정방송사의 단독중계보다는 공동중계와 편성의 차별화가 필요하며, 이를 위해 법적개선방안을 검토할 필요가 있다. 첫째, 호주의 안티 호딩규칙(Anti-hoarding rule)을 도입하여 행사의 미사용분을 공영방송에 양도하는 것이다. 둘째, 이탈리아처럼 특별행사에 대해 개별 방송사가 단독중계권을 가지지 못하게 하는 것이다. 셋째, 인도의 경우처럼 공영방송을 우선방송사로 선정하거나 공영방송이 개입된 컨소시엄을 강제하는 것이다. 공영방송은 국민의 수신료가 제도화된 국민의 방송이므로 국민적 관심사를 우선적으로 반영하는 방안을 고려할 필요가 있다.
Abstract
In the early 2000s, the surge of sports broadcasting rights were highlighted several times. and the National Assembly amended the Broadcasting Act. but, the regulation of universal access is not clear in the Listed events and Preferred broadcasters. also, preventing excessive competition rather than universal access is focused. Such as the World Cup and Olympics, the global village sports festival is needed to joint broadcasting, so it is necessary to consider legal reform measures. First, introducing Australia's anti-hoarding rules, any unused portion of the listed event should be transfer to the public broadcasting. Second, such as the case of Italy, the exclusive rights to individual broadcasters are prohibited. Third, as like the case of India, by introducing the priority to the public broadcaster or a consortium involving the PBS should be forced. Since the public broadcaster is broadcasting for people, national sports events should be considered in priority.
