방송법의 ‘국민관심행사’ 정책 비교 분석 -영국, 호주 및 한국을 중심으로-

스포츠방송권의 가격급등을 막고 국민들의 보편적 시청권을 보장한다는 명분으로 실시된 국민관심행사 정책이 실질적으로 효과를 발휘하지 못하고 있다. 국민관심행사 정책이 시행된 이후에 상업방송의 주요 스포츠 독점이 심화되고, 국민관심행사의 선정기준에 유료방송인 케이블TV, 위성방송 그리고 IPTV 가구가 합산되어 무료로 국민들에게 볼거리를 제공한다는 입법취지가 사라지고 말았다. 이에 국민관심행사 정책은 우선방송사의 무료방송 개념과 국민관심행사를 명확하게 규정하는 작업이 필요하다. 또한 상업방송의 주요스포츠 독점을 막기 위해 중계권을 의무적으로 공영방송에 양도하는 안티 호딩규칙을 도입하는 것이 필요하다.
Abstract
‘Listed Events’ policy in sports broadcasting are enacted in broadcasting act in 2007. but the effect of the policy is questionable. on the contrary, the monopoly of commercial broadcasting in the major sporting event are deepened and pay broadcastings as like cable TV, satellite broadcasting and IPTV, are included into the concept of ‘free broadcasting’. so legislative intent of ‘Listed Events’ policy are disappeared. It is necessary to define clearly the concept of free broadcasting and liste events. also need to introduce anti-hoarding rule to prevent monopoly of commercial broadcasting major sports broadcasting rights to transfer to public broadcasters.
