로스쿨의 출범과 법률시장 개방 등의 법조환경 변화로 인해 이제 변호사업계의 전문화는 거스를 수 없는 시대적 요청인바, 이를 위해서 전문변호사제도를 도입하자는 논의가 수년전부터 있었고, 드디어 2009. 9. 14. 대한변호사협회는 「변호사 전문분야 등록에 관한 규정」(규정 제80호)를 제정하여 사실상 전문변호사제도를 도입하였다. 그러나, 변협의 이 제도는 (1) 변호사법에 관련 근거 규정이 없이 변협 규정으로만 실시되고 있는 점, (2) 전문분야가 지나치게 세분화되어 있다는 점, (3) 가장 중요한 전문분야 심사기준이 구체적이지 않다는 점, (4) 등록갱신 요건이 부적절하다는 점 등이 큰 문제점으로 지적될 수 있다. 따라서, 현행 전문변호사제도는 변호사법 개정 등을 통해서 법적 근거가 마련되어야 하고, 전문분야를 통폐합하여 정리할 필요가 있으며, 심사기준 역시 현재의 법조인 양성 시스템과 결부되도록 보다 구체적으로 정해져야 하고, 등록갱신 요건 역시 재검토가 필요하다. 더 나아가 이 제도가 활성화되기 위해서는 광고 등에 전문분야 표시를 허용하는 이외에도 추가적인 각종 인센티브의 부여를 고려해 보아야 한다.
Abstract
In the advent of the new law school system and the opening of the legal market, the specialization of the attorneys has been an impending issue in the Korean legal society. There have been some discussions on this issue for years and finally the Korean Bar Association (KBA) made a new regulation on the registration of the specialty areas (Regulation No. 80) on September 14, 2009. However, it has several serious problems such as lack of legislative basis, extreme itemization of the specialized area, vagueness of the registration standard and inadequacy of the renewal requirement. Hence, the Attorney's Act should be amended to include this new system. Also, the regulation should be revised in order to simplify the specialized area, specify the registration standard, and reform the renewal requirement. Moreover, some incentives should be considered to activate the system.
