WTO법에서 ‘동종성’(likeness)의 개념과 한계

초록

국제통상법에서 동종성을 해석하는 것은 결국 ‘차별’(discrimination)과 ‘차등’ (differentiation)을 구별하는 것이다. 지난 1947년 GATT 이후 현재까지 수많은 분쟁들에서 ‘차별’과 ‘차등’을 구별하는 기준으로 동종성에 대한 해석은 일견 확고한 원칙을 갖고 있는 것처럼 보였지만 사실 수많은 해석의 가능성을 보이는 모호한 위치에 놓여 있었다. 지금까지의 WTO 및 국제통상관계에서의 결론은 상품무역이나 서비스무역 등 주요 통상규범에서 제기되는 동종성 판단의 틀은 크게 다르지 않다는 것과, 과거 1947년 GATT체제 이후 유지되어 온 관행이 현재에도 큰 수정 없이 적용되고 있다는 점이다. 비록 세부 협정들이 갖는 목적이 서로 다르기 때문에 제기되는 부분적인 특수성이 인정된다 하더라도, 통상법이 추구하는 ‘차별’과 ‘차등’의 구별을 위한 동종성 판단의 기준 또는 방법은 과거 전통적이 BTA 접근법에서 크게 달라지지 않았고 이는 지금도 여전히 해석에 따른 논쟁을 불러오는 원인이 되고 있다. 불구하고, 변화하는 국제환경과 통상법의 발전은 동종성 판단의 기준과 방법론에 있어서도 새로운 경향을 나타내기 시작하였다. 이러한 움직임은 ‘EC-석면 사건’에서 출발하여 기존 BTA 접근법이 갖고 있던 한계를 다소 보완하고 수정하는 노력을 보여주고 있다. 비록 이러한 움직임이 아직까지 확고한 원칙으로 인정되는 것은 아니고 다른 시각에서는 ‘새로운’ 접근법이 아니라 단순한 기존 해석론에 대한 수정에 불과하다는 비판도 가능하지만, 과거 GATT 시절부터 이어져 온 관행에 대한 일종의 변화라는 관점에서 볼 때 이러한 변화는 충분히 의미 있고 평가받을 수 있는 것으로 보인다.

Abstract

This article is mainly based on some puzzled concept of “likeness” and interpretation methods/ theories of “like products” in the WTO law and legal practices. This consists of 2 main chapters. Setting apart from introduction, chapter I and conclusion, chapter IV, main body deals with following ideas: One part, chapter II mostly dealt with a current issues of interpretation of “likeness” and “like products.” That is, this chapter firstly introduced the legal problems in interpreting “likeness” and “like products” of trade in goods. And more, other interpretation issues originated in trade in services are also dealt in chapter II additionally. And next to these analyses, chapter II lead to the sub-conclusion, the limitation of current interpretation of “likeness” and “like products.” And the other part, this article examined lots of legal issues in interpreting the concept, “likeness” and “like products,” and suggested the reasonable changes of the interpretation. Firstly, it can be connected with the concept and theory of BTA approach, and secondly, this article examined the possibility of introducing a new concept and/or theory, that is so-called “market-based approach”, of interpretation of “likeness” and “like products.” And as a sub-conclusion, it was dealt with expectation and suggestion of oncoming interpretation issues, “revising aim-and-effect” theory. After considering all these issues, this article finally called WTO member’s attention to a shift in their attitude of interpretation of “likeness.”
