Abstract

The unreasonable determination of the protection scope of patented inventions make it difficult to promote industrial development. Therefore, The determination of protection scope of patented inventions is very important issue. However, All Elements Rule that present the criteria for the interpretation of the scope of protection of the patented inventions is a old theory established at the time when one dimensional inventions were in the majority. Thus All Elements Rule can lead to unreasonable conclusions in the field of gene patents, a new paradigm technology. The reason is that gene inventions have the properties of the material as well as the properties of the information unlike the mechanical inventions or general chemical inventions. It is difficult to say that it belongs to the scope of protection of the patented inventions because it is inclusive relation. On this, this paper suggests the utilization of transitions, especially hybrid transitions for gene patents. The domestic patent practice in Republic of Korea has not yet given a special meaning to transitions when interpreting the scope of protection of the patented invention. Moreover there are transitions in ambiguous form. However, if we use transitions as a means of supplementing All Elements Rule for determination of protection scope of patented inventions like patent practice in the United States, especially hybrid transitions for gene patents, it is possible to solve the above unreasonable conclusion in accordance with Patent Act Art. 97. The protection scope of claims with hybrid transitions is excluded from the protection of the patent, in case there is material changes in the basic and novel characteristics of the invention. On the other hand, if an open claim is applied to a gene patent, it may not be appropriate to have rights to a totally different subject, and if a closed claim is applied, the scope of protection may become too narrow and the genetic engineering industry may decrease. However, claims with a hybrid transition can make a balanced approach between the right holder and the third party. Furthermore it can contribute to industrial development. In addition, it is possible to improve the normative function of claims by arranging ambiguous transitions in the present patent practice and promote the predictability of interpretation of protection scope of the patented inventions.
