Abstract

When a potential medical malpractice accident occurs, the medical care provider (‘MCP’) may feel reluctant to apologize to the patient and his/her family because the MCP may worry hat his/her apology would be used as evidence for his/her admission of fault or liability. In this regard, most of Canadian provinces have adopted the Apology Acts, upon which the MCP’s apology shall neither constitute as an expressed or implied admission of fault or liability nor be admissible as an evidence of fault or liability in the medical dispute resolution processes, including in civil proceedings. Its aim is to resolve medical disputes in an amicable manner and in short permit voluntary apologies from MCP to the patient. However, upon the study of Canadian Apology Acts, it would hardly be that such Apology Act provisions would function under the Korean legal regulations in regard to the Korean evidence rule on the legal side. So it is believed that the Apology Act provisions would be adopted in Korea only after, upon the sufficient scientific and empirical following studies, to find it would it be substantially helpful as in the medical dispute resolutions.
