정보보안법제의 문제점과 개선방안 - 해외의 관련규정과의 비교를 중심으로 -

인터넷을 통한 세계화는 국경을 사라지게 하고 실시간으로 모든 국가의 사람들이 소통할 수 있도록 만들어주는 긍정적인 역할을 하였다. 그러나 모든 국가의 중요한 정보들이 인터넷을 통해 흐르는 상황으로 인해 사이버공간은 새로운 전쟁터로 급부상하고 있다. 특히 사이버전쟁은 침입상황이나 피해 등이 즉시 외부로 드러나지 않는 경우가 많기 때문에 오히려 일반적인 전쟁보다 그 피해가 심각할 수도 있다. 탈린메뉴얼 탄생의 계기가 되었던 최초의 사이버전쟁 이후 각국은 정보보안에 대한 경각심을 새롭게 자각하고 정부기관 간의 정보보안 수준에 대한 최소한의 기준이나 관련 사건의 발생 시에 대응방안 등에 대해 구체적이며 체계화된 대응전략을 마련하고 있으며, 국가차원의 정보보안에 관한 구체적인 법률이나 매뉴얼 등을 제정하여 운영하고 있다. 그러나 우리나라의 경우에는 대통령령이나 훈령 등을 통해 정보보안에 관한 규정을 마련하고, 국가정보원이 독점적인 권한을 행사하도록 하고 있기 때문에 정보보안에 관한 사항을 국가정보원 이외에는 사실상 알 수 없는 상황이다. 현대사회에서 정보보안은 국가의 운명을 좌우할 수 있는 중요한 사항이기 때문에 정부의 주도 하에 민관의 협력을 통해 통일적이고 체계적으로 대응하는 것이 중요하다. 따라서 우리나라도 정보보안에 관한 단일 법규를 제정하고 현재 두 개의 규정으로 나누어져 있는 정보보안에 관한 사항 등을 통일적으로 관리하고, 민간과의 협력을 통해 효율적이고 근본적인 대응을 위해 노력해야 할 것이다.
Abstract
The 21st century is witnessing a rapid change in global power balance along with globalization. The security environment around korea has become increasingly severe as represented by nuclear and missile development by North Korea. Transnational threats grounded on technological progress including international terrorism and cyber attacks are also increasing their significance. Information security is the ongoing process of exercising due care and due diligence to protect information, and information systems, from unauthorized access, use, disclosure, destruction, modification, or disruption or distribution. Most countries are preparing regulations for the information security. but Our country is no single law concerning information security such as foreign country. We are also to swiftly devise a plan for the information security and At the instigation of the government through public-private partnerships, efficient and systematic information security have to do so as to ensure.
