우리가 접하는 언론을 통해 본 아프리카는 인간의 기본적인 권리에 대한 인식이 부족한 대륙으로 알고 있다. 그러나 아프리카에서는 지역적 인권의 보장을 위하여 헌장을 규정하고 이를 실효적으로 보장하기 위한 기관을 설립하는 등의 다각도로 노력을 하고 있다. 아프리카 인권헌장(개인 및 인민의 권리에 관한 반줄헌장(Banjul Chater))은 1981년 6월 아프리카 기구인 OAU의 정상회의에서 채택되어서 1986년 10월에 발효된 지역적 인권선언이다. 아프리카 인권헌장은 아프리카의 식민지주의와 신식민지주의 그리고 인종차별을 반대한다는 것을 명백히 하고, 아프리카 대륙의 국가들의 연대의 강화와 발전을 위한 노력을 호소하는 선언문이라고 할 수 있다. 그리고 유럽 중심의 인권개념을 비롯하여 경제, 사회, 문화적 부분의 인권까지 추구하는 적극적 성격이 있는 선언문으로서 개인의 권리뿐만 아니라 민족의 권리까지 보장하고 있다. 아프리카 인권위원회는 아프리카 대륙의 인권상황을 조사하고 인권과 관련된 규칙을 정립․해석하여 인권침해사건을 판단하고 있다. 본 논문에서는 아프리카 인권헌장상 직접, 간접적으로 보장하고 있는 사회권의 권리에 아프리카 인권위원회의 결정과 의미를 고찰하고자 한다.
Abstract
Africa is known through the media as a continent that doesn't take considerations on the basic human rights. In fact, however, this huge continent puts various efforts into the security of regional human rights by establishing a charter and an organization for the effective protection of the rights. The African Charter on Human and People's Rights that is also known as Banjul Charter was a declaration of regional human rights that was adopted in June, 1981, in the summit of the Organization of African Unity and took effect in October, 1986. This charter could be regarded as a declaration that is against colonialism, new-colonialism and racial discrimination in Africa and appeals to African countries for concerted efforts for mutual solidarity and development. Furthermore, this actively embraces the European notion of human rights, seeks after human rights in terms of all the economy, society and culture, and guarantees not only individual rights but also racial rights. African Commission on Human and Peoples' Rights makes an investigation into the state of human rights in the African continent, formulates rules for human rights and interpret the rules in order to properly judge human-rights violation incidents. The purpose of this study was to examine the decisions of African Commission on Human and Peoples' Rights and the meaning of the decisions in conjunction with social rights directly and indirectly guaranteed by the African Charter on Human and People's Rights.
