국제해저기구는 심해저 광물자원의 상업적 개발을 위한 규범을 제정하기 위해 노력하고 있다. 심해저 광물자원의 상업적 개발은 유엔해양법협약과 이행협정의 관련규정에 부합하여 제정되어야 한다. 국제해저기구는 개발규칙을 제정하기 위해 많은 논의를 하고 있으며, 2017년 8월 법률기술위원회는 개발규칙 초안을 작성하여 배포하였다. 심해저 광물자원의 상업적 개발을 위한 핵심이슈는 로얄티를 포함한 지불제도, 개발기간, 해양환경보호, 자료의 제출 등이 있다. 본 논문에서는 심해저 광물자원의 개발을 위한 국제해저기구의 논의과정을 조사하고 상업개발을 위해 다루어야 할 물제들에 대해 논의하고자 한다.
Abstract
The International Seabed Authority(ISA) is working to establish norms for the commercial development of deep-sea mineral resources. Commercial development of deep seabed mineral resources requires the formulation of practical exploitation regulations along with relevant provisions of the UNCLOS and the Implementation Agreement. In the meantime, the ISA has been discussing for many years to formulate the exploitation regulations. In August 2017, the Legal and Technical Commission drafted and distributed the exploitation regulations. Key issues for the commercial development of the deep sea mineral resources are discussed including the payment system including royalties, the development period, protection of the marine environment, and submission of data. In this paper, I will examine the discussions in the ISA for the development of deep-sea mineral resources and the issues that are dealt with in commercial development.
