유럽연합(EU)의 입법절차에서 영향평가위원회(the Impact Assessment Board)의 역할 및 운영에 대한 연구

법은 국가정책을 실현하고 국민의 권리를 보호하는 가장 중요한 수단으로 국민에게 미치는 영향이 크다. 이에 따라 법을 통하여 국민의 행복을 증진시키기 위해서는 좋은 법의 제정이 필요하며, 좋은 법을 제정하기 위해서는 입법과정에서 면밀한 입법영향평가(입법평가, 입법영향분석)이 요구된다. 1993년 11월 1일 정식 발족한 유럽연합(EU)의 주요 과제 중의 하나가 각종 규범의 개선이었다. 유럽연합에서는 이에 대한 지속적인 논의의 결과 2003년 새로운 영향평가(impact assessment)제도를 도입하였다. 유럽연합의 영향평가제도는 입법제안과 정책제안을 모두 대상으로 한다는 점에서 통상의 입법영향평가 보다는 넓다. 그리고 영향평가 대상의 약 70% 정도가 입법제안임을 고려할 때, 유럽연합의 영향평가는 실질적으로는 입법영향평가제도로 볼 수 있을 것이다. 유럽연합에서는 유럽위원회(the European Commission)가 영향평가를 실시하고 영향평가보고서를 준비하는데, 유럽위원회의 영향평가제도의 실무적 운영을 돕기 위하여 2005년 6월 15일 영향평가가이드라인(Impact Assessment Guidelines)을 제정하였다. 그리고 영향평가에 대한 독립적인 질적 통제 및 질적 지원을 제공하기 위하여 2006년 말에 “영향평가위원회(Impact Assessment Board)”를 설치하였다. 영향평가위원회의 설치목적은 유럽위원회의 영향평가에 대해 독립적인 질적 통제를 하고 유럽위원회의 영향평가를 질적으로 지원하기 위한 것이다. 영향평가위원회는 “영향평가위원회 절차규칙(Rules for Procedure of the Impact Assessment Board)”에 따라 운영되고 있다. 영향평가위원회는 정책입안 부서(policy making departments)와는 독립적이며, 유럽위원회의 각 담당부서가 준비한 모든 영향평가보고서 초안에 대하여 질적 수준을 심사하고, 영향평가의 개선사항에 대한 권고를 포함하는 의견서(opinion)를 채택하여 영향평가기관에 제출하고 발표한다. 영향평가위원회는 심사를 위한 회의를 개최할 수 있는데, 회의는 비공개로 진행된다. 영향평가위원회의 의견서는 구속력은 없지만, 영향평가위원회의 의견서와 최종 영향평가보고서는 유럽위원회의 전 의사결정과정에서 정책제안(입법제안)서에 수반되어지며, 정책제안(입법제안)이 채택되면 대중에게 공표된다. 2010년 9월 유럽감사원이 발표한 자료에 의하면, 영향평가위원회는 영향평가의 질적 수준을 제고하는데 기여를 한 것으로 밝혀졌다. 그리고 유럽정책연구소(the Centre for European Policy Studies (CEPS))의 연구결과에서도 유럽위원회는 영향평가제도를 성공적으로 운영하고 있고, 영향평가위원회의 설치는 영향평가제도에 긍정적인 영향을 준 것으로 밝혀졌다. 우리나라에서도 멀지 않아 일부 제한적으로 입법영향평가제도가 도입될 것으로 보인다. 위에서 살펴본 바와 같이 입법유럽연합의 영향평가제도 및 영향평가위원회는 유럽연합의 입법절차에서 긍정적인 역할을 하고 있다는 것이 확인되었다. 이에 따라 우리나라에서 입법영향평가를 제도화할 때, 영향평가위원회의 설치에 대해 긍정적으로 검토할 필요가 있다.
Abstract
The European Commission’s Impact Assessment system was introduced in 2003, replacing and integrating all sectoral assessments of direct and indirect impacts of proposed measures into one global instrument. Impact Assessment also responds to the Better Regulation agenda, and represents an important step in the Commission’s efforts to enhance the quality of its regulatory activity. The Impact Assessment Board (IAB) was established by President Barroso in 2006 to provide independent quality control and quality support for Commission impact assessments. The Board is a central quality control and support function working under the authority of the Commission President. The Board is independent of the policy making departments. Its members are high-level officials from the Commission departments most directly linked with the three pillars of the impact assessment - economic, social and environmental impacts. The members have been appointed in a personal capacity and on the basis of their expert knowledge. The Board examines and issues opinions on all the Commission's impact assessments. The opinions of the Board are not binding. However, the opinion accompanies the draft initiative together with the impact assessment report throughout the Commission's political decision-making. All impact assessments and all IAB opinions are published once the Commission has adopted the relevant proposal. The Commission impact assessment is an aid - not a substitute - for political judgement. Ultimately it is the Commission which decides whether or not to adopt an initiative, taking account of the impact assessment and the Board's opinion.
