독일은 정책 거버넌스 대부분의 영역에서 국가적 가치관과 장기적 국가 어젠다를 실제화하기 위해 노력한다. 규제는 이를 보여주는 주요 사례 중 하나이다. 관료주의 감소를 대주제로 하는 입법영향평가 과정은 전 과정이 단계별로 모듈화 되어 있다. 입안 전에 이루어지는 사전적 영향평가, 초안 발표 후에 이루어지는 병행적 영향평가, 입안 이후 이루어지는 사후적 영향평가가 그것으로, 기능주의적 체계에 따라 실행과 통제를 매 단계에서 가능하게 한다. 이는 체계분화 이론이 논한 자기체계생산적 발전 양상이며, 사회 내부 체계를 중시한다는 뜻이기도 하다. 최근 규제 거버넌스의 미시적, 거시적 변화가 감지되었는데, 규제 핵심 기관이 이관하고 관료주의 어젠다가 변화하는 양상을 보였다. 이 논문은 이러한 최근 변화를 구조기능주의의 새로운 양상으로 분석하며, 독일의 사례는 자기 체계적 맥락에서 발전을 거듭하는 중임을 시사하고 있다.
Abstract
Germany is committed to realizing its national values and long-term national agenda in most areas of policy governance. Regulation is one of the important examples. The whole process of legislative impact evaluation, with bureaucracy reduction as main theme, is modularized in stages. Ex-ante Evaluation before drafting; Process Evaluation after draft presentation; and Ex-post Evaluation after drafting make execution and control possible at every stage according to the functional system. This is the self-systematic development aspect discussed by the theory of systemic differentiation, and it also means that the internal system of society is important. Recently, micro and macro changes in regulatory governance have been detected, with key regulatory agencies shifting and bureaucratic agendas changing. This paper analyzes these recent changes as a new aspect of structural functionalism, suggesting that the case of Germany is continuing to develop in a self-systematic context.
