Abstract

This study analyzes the EU Artificial Intelligence Act (AI Act) and its suitability for governing generative and general-purpose AI. The Act, modeled on traditional product safety law, classifies risks by intended purpose and context, providing initial stability but failing to reflect technological realities and emerging harms. It attributes risks mainly to dataset errors, overlooking extra-data risks such as emergent capabilities, dual-use, and shifting purposes. High-risk classifications remain confined to limited domains, leaving unaddressed the systemic risks posed by large models. Safety requirements assume compliance at the design stage, which is ill-suited to general-purpose and non-deterministic systems, placing disproportionate burdens on downstream users. The FLOPs threshold, though intuitive, oversimplifies the relationship between capacity and risk, enabling regulatory evasion. Future regulation should reconsider AI’s definition, broaden risk categories, expand oversight to socio-technical systems, and supplement ex ante requirements with dynamic measures such as monitoring, red-teaming, and incident disclosure to safeguard both technical safety and fundamental rights.
