Abstract

This article provides an in-depth analysis of the European Union’s Artificial Intelligence Act (EU AI Act) and examines its implications for South Korea’s AI regulatory policy. The EU AI Act adopts a risk-based approach, categorizing AI systems into four risk levels: prohibited, high-risk, limited risk, and minimal risk, with differentiated regulations applied accordingly. This article compares the risk classification system of the EU AI Act with South Korea’s proposed AI-related legislation bills. While the EU AI Act offers a comprehensive regulatory framework, its direct application to South Korea may not be appropriate due to differences in technological capabilities, industrial structures, and sociocultural contexts. This article argues that South Korea should develop a flexible and context-specific regulatory approach that balances AI innovation with effective risk management. Notably, this article proposes leveraging existing legal frameworks, such as the Korean Personal Information Protection Act and the Product Liability Act, to address many AI-related issues. This article also emphasizes the need for a comprehensive review of introducing mandatory disclosure of AI training data, considering the potential for increased copyright infringement litigation. This issue should be examined in conjunction with the introduction of Text and Data Mining (TDM) exemption provision in the Korean Copyright Act.
