본 연구는 대한민국의 현행 법률 체계 하에서 전자증거개시(e-Discovery) 시장의 활성화 가능성을 분석하고, 인공지능(AI) 기술을 활용한 혁신적 e-Discovery 솔루션의 도입 방안을 제시한다. 연구 결과, 정부의 한국형 디스커버리 제도 도입 의지, 국내 기업의 해외 소송 증가, 그리고 우수한IT 인프라를 바탕으로 한국 e-Discovery 시장의 활성화 가능성이 매우 높은 것으로 분석되었다. 특히 Technology Assisted Review(TAR), 자연어 처리(NLP), 생성형 AI 등 최신 AI 기술의 적용을통해 전통적인 문서 검토 방식 대비 75∼90%의 시간 단축과 30∼40% 높은 정확도를 달성할 수있음을 확인하였다. 본 연구는 한국형 e-Discovery 시장 발전을 위한 정책적 시사점과 함께 AI 기반 솔루션의 구체적 활용 전략을 제시한다.
Abstract
In this study analyzes the potential for activating the e-Discovery market under the current legal framework of the Republic of Korea and proposes implementation strategies for innovative e-Discovery solutions utilizing artificial intelligence (AI) technology. The research findings indicate a high likelihood of e-Discovery market activation in Korea, based on the government's commitment to introducing a Korean-style Discovery system, the increasing number of overseas litigations involving domestic companies, and the country's robust IT infrastructure. In particular, the study confirms that the application of cutting-edge AI technologies such as Technology Assisted Review (TAR), Natural Language Processing (NLP), and generative AI can achieve a 75∼90% reduction in time and 30∼40% higher accuracy compared to traditional document review methods. This research presents policy implications for the development of the Korean e-Discovery market along with specific utilization strategies for AI-based solutions.
