EU의 생산물책임법의 역내 이행

초록

소비자들은 ‘1차 농업생산물’을 포함하는 생산물의 안전에 큰 관심을 갖고 있다. 유럽에서는 1990년대 후반 영국의 광우병과 벨기에의 다이옥신오염과 같은 사건으로 식품안전과 소비자보호를 위한 ‘책임제도’의 도입 및 강화의 필요성을 절실히 경험하였다. 이로써 EU는 ‘1차 농업생산물’이 포함된 생산물에 대한 ‘엄격책임’의 체계를 확립하여 역내시장에서 안전하고 위생적이며, 건강에 좋고 고품질인 식품 생산물의 제공을 촉진하게 되었다. 그러나 지침 85/374와 지침 99 /34에 의해 확립된 ‘생산물책임 체계’의 개정 필요성이 제기되고 있다. 즉 1999년 7월 28일 ‘생산물책임에 관한 그린페이퍼’에서 강조되었던 최소손해액 500유로, 개발위험의 항변, 공급자책임의 한도와 같은 문제들이 잔존하고 있다. 특히 ECJ의 주요 판결 이후에는 더욱 그렇다고 할 수 있다. 특히 GMO의 안전성문제와 관련하여, 만일 식품안전의 문제가 먼 미래에 발견된다면, 현재는 ‘개발위험의 항변’이라는 면책수단에 의해 생명(생물)공학 산업이 과연 그 책임을 회피할 수 있겠는가 하는 것이다. 따라서 생산물책임지침에 의해서 확립된 ‘엄격책임’ 체계를 더욱 강화하기 위하여 필요한 경우에는 지침을 개정할 필요가 있다. 그리고 이러한 맥락에서 결함 있는 생산물에 대한 책임 외에도 수많은 사법 영역을 다루고 있는 EU의 공동참조기준초안(DCFR)은 EU사법의 통일적 적용에 있어서 매우 고무적인 결과라고 할 수 있다. 이러한 EU의 생산물책임법은 한-EU FTA의 발효에 있어서도 중요한 의미가 있다고 할 수 있다.

Abstract

In these days, the issues of product liability and product safety have become more and more important in the European Union. Council Directive 85/ 374 seeks to approximate the laws of the Member States concerning the liability of producers for damage caused by defective products. Specially, the Directive introduces a system of liability without fault. And under EP/Council Directive 99/34 the primary agricultural product was included within the scope of the product liability Directive. Therefore the extension of the product liability Directive to include primary agricultural products would merely constitute a complimentary measure. The strict liability regime to cover primary agricultural products will act as an incentive to the placing of safe, healthy, high quality food products on common market of the EU. In recent several cases the European Court of Justice pointed out the product liability Directive prevented Member States from establishing strict liability laws which provided for greater liability than prescribed by the product liability Directive. But, there are necessities to revise the provisions such as the financial limits of 500 Euro and the development risks defence. The other side Draft Common Frame of Reference covering accountability for damage caused by defective products is very encouraging in the unification process of european private law. Lastly, if Korea-EU FTA conclude, Korea must give attention to understand the product liability law of the EU.
