2002년 7월 1일 제조물책임법을 제정・시행한 우리나라는 그동안 두 차례의 법률 개정을 통해 소비자의 권리보호를 강화하기 위해 입법적 노력을 다해 왔다. 다만 최근 들어 소프트웨어나 AI 등과 같이 이미 경제와 산업의 중심에 서 있는 첨단과학의 산물인 제품들을 제조물책임의 대상으로 할 것인지, 그 결함으로 인해 발생한 손해에 대한 책임 요건으로 유책성을 요구할 것인지, 증명책임의 추정 내지 전환을 인정할 것인지 등에 관한 쟁점이 국제적 논의과제가 되고 있다. 2022년 9월 28일 EU 집행위원회는 제조물책임 지침 개정안과 AI 책임지침안을 동시에 공표한 바 있다. 금년 말이나 2024년 중으로 유럽의회의 승인을 거쳐 회원국 내 국내법으로 연결될 것이라는 예측이 지배적이다. 양 지침의 내용은 자율주행 자동차, 인공지능 로봇 등을 첨단 주력산업으로 전환하고자 하는 우리나라 기업에도 상당한 영향을 미치게 될 것이므로 이에 대한 적절한 대비가 필요하다. 제조물책임의 주체와 대상의 확대, 증명책임의 완화, 온라인 마켓플레이스 거래에 대한 규율, 증거개시제도의 도입을 둘러싼 여러 쟁점에 대한 대응은 우리나라 제조물책임법의 중요한 입법 과제가 될 것이다. 국제적인 입법 추이를 면밀히 관찰하면서 이와 조화할 수 있는 입법 방향을 설정하고 그 구체적인 내용을 검토해 나가야 할 때이다.
Abstract
Consumer products in the digital age are transforming the way they are produced, distributed and operated. In particular, products with advanced technologies such as artificial intelligence (AI) bring great benefits to mankind, while also increasing potential risks. The current Civil Liability Act does not consider new transaction forms through online platforms. In order to clarify the legal responsibility of companies and properly compensate for damages suffered by consumers, new liability rules that reflect these environmental changes must be established. In this regard, the recent legislative response of the European Union (EU) is attracting attention. The revision of the Product Liability Directive (COM (2022) 495 final.) and the AI Liability Directive, which can be applied complementaryly, were announced at the same time. These two Directives will be promulgated by 2024 at the latest and will be enacted into the national law of the Member States within the period set by the Directives. Changes in international legislative trends, including those in Europe, are expected to have a significant impact on Korean companies that want to transform self-driving cars and artificial intelligence robots into high-tech flagship industries. As reviewed earlier, the EU's two Liability Directives announced in September 2022 are expected to have a significant impact on future legislation in Korea. It is necessary to closely observe international legislative trends and set the direction and contents of domestic legislation.
