본 논문은 ‘파산신청이 파산절차의 남용에 해당한다고 인정되는 때의 의미’에 대한 최근의 대법원 2009. 5. 28.자 2008마1904, 1905 결정을 소재로 ‘경제적 파탄에 빠진 채무자에 대한 새출발의 도모’와 함께 ‘파산절차의 남용에 대한 규제’라는 얼핏 서로 배치되는 이익 상황을 염두에 두면서, 미국 연방파산법(Bankruptcy Code)에 눈을 돌려, 파산제도의 이용규제를 위해 2005년 연방파산법의 개정법인 「2005년 파산남용방지 및 소비자보호법」(Bankruptcy Abuse Prevention and Consumer Protection Act of 2005)이 새로 채택한 변제자력조사(means testing)를 소개하고, 이로부터 우리 개인파산제도의 운영에 있어서 약간의 시사점을 살펴보았다.
Abstract
The personal bankruptcy is positioned as a system that has an important function of essentiality for the debtor's economical fresh start today. Although the positive function of its essentiality, the bankruptcy abuse is at issue. Recently, there was the Supreme Court Order (the Supreme Court Order 2008Do1904,1905 Dated May 28, 2009) about the abuse of bankruptcy procedure. This paper analyze this Order and examined the following Means Testing in the New 11 U.S.C. § 707(b). In 2005, the United States substantially changed its bankruptcy laws, adding a means test to prevent wealthy debtors from filing for Chapter 7 Bankruptcy. The means test provides for a finding of abuse if the debtor's income is higher than a specified portion of their debts. If a presumption of abuse is found under the means test, it may only be rebutted in the case of “special circumstances.” Debtors whose income is below the state's median income are not subject to the means test.
