유럽연합 사법재판소 판단의 집행력에 관한 문제 - 유럽연합 차원에서의 형사법 규율실태를 중심으로 -

유럽연합은 자신만의 통합의 차별화를 꾀하고 있다. 오히려 유럽연합은 통합을 포기하지 않고 있으며 이의 진전을 위하여 최선의 노력을 기울이고 있다. 특히 유럽연합 사법재판소는 유럽연합법 우위의 원칙을 개발하여 유럽연합의 통합에 힘을 보태고 있는데 사법재판소는 유럽연합법의 직접 효력의 원칙과 직접 적용의 원칙을 통하여 당해 유럽연합법 우위의 원칙을 구체화하고 있는 것이다. 하지만 유럽연합이 특히 사법제도의 집행과 관련하여 직접적인 집행 수단을 확보하고 있지 못하고 있다는 점에서 그리고 독자적이고 고유한 행정집행기능 역시 보유하고 있지 못한 점에서 자신의 통합을 성공적으로 도모하고 있다는 그간의 평가는 결국 회원국의 협조가 있었기 때문에 가능하였다는 평가가 가능하다. 독일 연방헌법재판소를 위시한 회원국의 여러 기관이 유럽연합 혹은 유럽연합 사법재판소의 독단적인 통합 추구에 대하여 반기를 들었던 적이 적지 않은 것이 사실이지만 전반적으로 유럽연합 차원의 통합에 대하여 협조의 자세를 고수하고 있는 것이 사실이기도 하다. 하지만 통합의 주도권을 꾸준히 확보하려는 유럽연합으로서는 집행력 확보를 위하여 적지 않은 노력을 포기하지 않고 있다. 향후 유럽연합에 의한 집행력 확보의 구체적인 모습은 연합의 통합정도를 평가할 수 있는 단서를 제공해 줄 것이다. 유럽연합이 그 효과적인 통합을 도모하고는 있지만 여전히 연합법의 집행력 확보에 애를 먹고 있는 것은 현 연합의 통합정도를 가늠해 볼 수 있는 단초를 제공해주고 있음은 물론이다.
Abstract
There is an ample possibility that EU will be transformed into a state on the ground that EU continues to make an effort to maintain and enforce the uniformity of legal order, though it is considered as circuitous method. However, I will be obliged to conclude that the identity as sui generis entity of European Union will be maintained by focussing on the perspective concerning the uniformity of EU legal order. However European Union has not obtained particular means to ensure the enforceability of its law. Still, European Union can not but admit the fact that the cooperation of Member States is required in terms of the advanced EU integration for the reason that Member States have been given the initiatives in integration. As a matter of fact, it is true that Member States obtain the capabilities to close the EU law as Dieter Grimm appropriately pointed out. Thus European Union has tried to cooperate with Member States in advancing its own integration. European Union has actually promoted the coordination with Member States in order to regulate and sanction the crimes relating to corruption because the implementation measures belong to Member States, not European Union. Of course, the continued trial of European Union to ensure the implementation and enforcement of EU Law will contribute to EU identity in the future.
