초록

본 연구는 미국 법현실주의를 대표하는 제롬 프랭크의 법이론을 종합적으로검토한다. 프랭크는 법과 현대 정신에서 법의 절대적 확실성을 근거 없는 신화에 불과하다고 비판한다. 그에 따르면, 법관의 판결은 법에 의해 구속되지 않을 뿐만 아니라 각각의 법관에게 고유한 성격과 경험의 영향을 받기 때문에 그결과를 예측하기조차 불가능하다. 또한 확실성 신화가 법에서 지속되는 까닭에대해서는 유아적 욕망에서 비롯한 것이라는 심리학적 설명을 제시한다. 연구는,통상적 이해와 달리, 성격 테제가 법관의 자의적 판결을 방조하는 것이 아니라오히려 사실회의주의에 기초하여 더 나은 판결을 모색하려는 시도이며, 아버지대체물 테제가 경험 과학적 설명이 아니라 법의 발전에 법관의 현대적 정신이필수적임을 보여주기 위한 픽션임을 논증한다.

Abstract

Jerome Frank is a core representative of American legal realism. Muchof his critique in “Law and the Modern Mind” levels at a basic legalmyth of legal certainty. He argues that law cannot bind judicialdecisions and that it is impossible to predict decisions because they areinfluenced by a trial judge’s idiosyncratic personality and privateexperiences. Also, Frank offers a psychological explanation on thereason the myth survives in law. This paper attempts to an alternativereading of Frank’s Personality thesis and Father-surrogate thesis. Acomprehensive study of his adjudication theories will show that he doesnot justify arbitrary judgments but finds a way to make a betterjudgment, and that his theory is not an empirical analysis, but a fictionto persuade that the modern mind of judges is a prerequisite fordevelopment of law and society.
