Abstract

The allowance of government employee union is a very important social issue in the aspect of securing fundamental labor rights which is the rights stated in the constitution. However, meanwhile, the fact that the Act on the Establishment and Operation of Public Officers’ Councils allowed the fundamental labor rights to public officers in limited method is coming from the lack of recognition of the nation on the fundamental labor rights. By considering the fact that such problem is not just a problem of securing and limiting abstractly rights but has direct impact to the quality of the working environment of each individual in reality, it is important to operate the public officer labor-management relations logically for the problem of extend and applying the fundamental labor rights of the special business public officers. The Act on the Establishment and Operation of Public Officers’ Councils had been practiced systemically, and it is certain that the quality of public officers’ working lives had been improved qualitatively through such. However, the problem of the fundamental labor rights of fire and police officers, which are the special businesses, is the task to be solve in the future in anyways. Concerning the problem which numerous fire officers having direct influence to their daily working conditions like overtime working allowance and shift system as they could not practice the fundamental labor rights, the voice of the concerned are not reflected. To solve such problem, the measures to use the existing the workplace meeting method to provide the rights of association and negotiation of the special business public officers who are excluded from the application target of the government employee union at the minimum level as a systematic passage is proposed.
