유럽연합 기본권 헌장 제26조는 장애인의 통합이라는 표제어로 장애인의 권리에 대한 주요 내용을 규정하고 있다. 즉 유럽연합은 장애인의 자립, 사회적・직업적 통합 그리고 공동체 생활 참여 보장을 위한 조치에 대한 장애인의 권리를 인정하고 존중한다고 규정하고 있다. 오늘날 가장 일반적이고 대표적인 사회적 약자를 위해서, 특히 장애인 보호를 위해서 우리 현행 헌법 제34조는 장애인 보호를 목적으로 관련 내용을 국가의 역할과 과제 등을 중심을 규정하고 있다. 이와 비교하여, 유럽연합 기본권 헌장 제26조는 장애인의 권리라는 기본권의 형태와 관련 내용으로 규정하고 있다. 유럽연합 기본권 헌장 제26조에 대한 고찰을 위해서는 장애인의 자립, 장애인의 사회적・직업적 통합 그리고 장애인의 공동체 생활 참여에 대한 검토와 분석에 주목해야 한다. 이와 더불어, 기본권 헌장 제26조는 장애인의 자립, 사회적・직업적 통합, 공동체 생활 참여의 보장을 실질적으로 실현하기 위한 조치에 대한 장애인의 권리라는 의미로 규정하고 있다. 따라서 장애인의 자립・통합・참여의 보장과 이를 위한 조치로 세분화하여 보다 체계적으로 살펴볼 수 있다. 이러한 여러 규정 내용은 궁극적으로 장애인 보호를 위한 권리 보장 실현의 기본적인 기조를 완성하였다고 할 것이다. 그리고 장애인 보호 목적의 실질적 실현을 위해서는 헌법적 차원에서 다루고 규정해야 할 내용과 사안이라는 인식을 보여준다. 이러한 여러 주요 내용에 대해서는 우리 헌법재판소도 여러 관련 결정에서 장애인의 보호와 관련한 여러 중요한 내용을 언급하고 있고, 유럽연합법원도 비교적 최근부터 장애인 보호와 관련한 여러 중요한 내용을 언급하고 있다. 이러한 다각적인 검토와 분석의 여러 내용이 기본권 헌장 제26조가 오늘날 우리에게 보여주는 중요한 의미이자 의지라고 평가할 수 있을 것이다. 또한 유럽에서의 여러 주요 논의 사항은 우리에게 전해주는 시사점은 크다고 할 것이다.
Abstract
This work deals with the topic on the protection of persons with disabilities and the implementation of the fundamental rights guarantee for persons with disabilities in the Charter of Fundamental Rights of the European Union (CFR). The Korean Constitution and the Charter of Fundamental Rights of the European Union stipulate the various regulations for the purpose not only for the protection of persons with disabilities but also for ensuring the rights of persons with disabilities. Today, most constitutions in the EU, like ours in Korea, write about protecting persons with disabilities and ensuring the rights of persons with disabilities. Article 34 in the Korean Constitution regulates basic social rights above all to protect persons with disabilities, so only all citizens have the right to live a decent life. The state must endeavor to promote social security and welfare, the state has to strive for the wellbeing and rights of women, the state has a duty to pursue policies that increase the wellbeing of the elderly and adolescents, and citizens who fail to make a living through disability, illness, old age or any other reason can contest themselves are supported by the state in accordance with the law. Article 34 play a significant role in the Korean constitution for people with disabilities. In addition, Article 26 of the Charter of Fundamental Rights of the European Union regulates the rights of persons with disabilities, namely The Union recognises and respects the right of persons with disabilities to benefit from measures designed to ensure their independence, social and occupational integration and participation in the life of the community. This article corresponds to the general basic principle in the EU such as Article 34 in the Korean Constitution for the protection of persons with disabilities and the implementation of the fundamental rights guarantee for persons with disabilities. The case law of the Korean Constitutional Court and the Court of Justice of the European Union lead to a practical strengthening for the guarantee of the rights of people with disabilities.
