Abstract
The law preserves and conveys its contents by means of words. As I was teaching at the law school, I had a chance to learn how students who didn't study law in their undergraduate felt about legal terms. They say that while the legal sentences are written in Korean, they are like foreign languages. Our legal language is seriously contaminated by Japanese language. That includes not only ① the jargon itself, but ② the Japanese grammar (the passive, past, progressive tenses), ③ Japanese kanji words that are read in Japanese native language, ④ the habit of using verbs as nouns, ⑤ ambiguous expressions (including duplication of negative words), ⑥ the Japanese unique speech habits, ⑦ using unnecessary words. We have been destroying Korean language to be hard to understand or difficult to listen to. And, using words that are understood only by Chinese characters or confused with other words in Korean texts that use only Korean alphabet(Hangul) also makes our language life uncomfortable. This phenomenon, of course, is not a matter of legal language alone. However, the legal language centering on civil law has a great influence on the language life of the country. The Civil Code is a standard of living for all citizens and is the basis of other laws. So Napoleon, while in the position of emperor, participated personally as a chairman of the civil code review meeting, making it easy to understand by anyone, but also made the code in beautiful French language, loved by the people and set an example for other countries. Because Germany enacted a civil law like a textbook (Pandekten system) unlike France, it was not easy for the people to understand, but it changed all the Latin legal terms those European countries used at that time to German native words. In the process, there were cases where one word in Latin was several words in German. However, we Koreans insist on Japanese legal terms and expressions those even Japanese people think that there are problems. Our people have lived as one nation for over 1500 years. I believe that if the trial is proceeded with a word that can be easily understood by anyone who has a civil code with beautiful and easy-to-understand Korean, it can be an opportunity to promote patriotism and self-esteem. It is language that connects people with people. If it is easy to communicate within the community and the conflict can be resolved in words that touch the heart, the idea of 'us' will become more solid. In the in the process of writing judgments as a judge, legal documents as a lawyer, and teaching law as a professor, I personally realized that our legal languages are not functioning, but impede understanding of the law. I came to deeply reflect on myself. So I would like to appeal, we should pay more attention to correcting the sickness of our legal language. The purpose of this article is to correct the legal terms in the code and Supreme Court precedents, and above all, to improve the odd sentences and unnecessary words of Japanese into easy-to-understand and concise Korean. Just in early 2018, the Ministry of Justice completed an easy-to-understand revision of the Civil Code. However, it is necessary to realize that the Japanese sickness condition is very deep in Korean language and to correct into the Korean language which is not odd to the general public, but the amendment of the civil law is not satisfactory in that respect. I hope that our civil law is clear and beautiful, so that even those who major in literature can read our civil law and get inspiration. Not only us, who live in this land, but also our descendants in the future, should be proud of our law, and be able to speak law without fear in our everyday lives and law courts.
