Abstract
This article focuses on an analysis of the Principle Theory, developed byRobert Alexy. The balancing power of the Constitutional Court is widelycriticized for its arbitrary character, because it takes no account ofargumentation, which is distinguished from motivation. Formal principle attempts to resolve the counter-majoritarian decisionsor counter-democratic decisions of the Constitutional Court. Alexy’s theorypursues Optimization and attempts a mix of formal principle and materialprinciple. Formal principle is not relevant in order to establish the natureor the scope of legislator’s discretion. Balancing is necessary in order to decide how serious an infringementwith constitutional principle is. But Optimization commands eliminatelegislator’s discretion. Ultimately, they bring monopolization the power ofthe Constitutional Court.
