소비자법상 철회권 행사기간과 그 기산-독일과 한국의 비교를 중심으로-

우리 소비자법은 1990년대에 처음 제정된 이후로 이렇다 할 발전이 없다. 최근 개정으로 단일한 체계로 철회권을 규정하는 독일민법은 우리나라 소비자법제에 있어서 큰 시사점을 준다. 철회권의 행사와 그 시기의 기산문제에 있어서도 그러하다. 철회권 행사의 기간의 산정에 있어서 일률적인 내용들이 세 개의 법률에 다른 형태로 독립되어 규정되어 있으나, 고유한 내용적인 면에서는 계약내용에 따른 차별의 이유가 거의 없어 보인다. 이러한 점에서 우선 철회권 행사기간을 통일적으로 규정해야 한다. 독일에서 철회권 행사와 관련하여 사업자가 소비자에게 제공하여야할 필수적인 정보를 제공하는 것을 동 권리의 행사기간의 기산의 시점과 연결하는 것은 사업자에 대한 제재 수단으로 적절하다고 할 수 있다. 이를 위해 행사를 위한 최장기간의 제한을 두어야 할 필요성은 있다. 또한 철회권에 관한 정보를 제공하지 않은 경우 그 “정보가 추완 될 때”까지 철회권 행사기간이 기산되지 않음을 분명히 규정해야 한다. 또한 철회권 행사기간의 기산을 위하여 “공급의 시작”이라는 불분명할 수 있는 내용을, 소비자 물건(실질적)수령이라는 것으로 개정함으로써 오해의 소지를 없앨 수 있다. 그러면 소비자의 물건에 대한 판단 가능한 시점이 조금 더 객관적이고 분명하게 기산된다.
Abstract
Our consumer law has not made much progress since it was first enacted in the 1990s. German Civil Code, which regulates the right of withdrawal as a single system by the recent amendment, has great implications for the Korean consumer legal system. This is also in the fact of the exercise of the right of withdrawal and its calculation. In the calculation of the duration of the exercise of right of withdrawal, the uniform content is defined as being independent of the three laws in different forms, but there is little reason for the discrimination based on the contract’s content. In this regard, the period of exercise of the right of withdrawal must be uniformly defined. German Civil Code provides a link between the time of the exercise of right of withdrawal and the provision of essential information that the business must provide to the consumer. There should be a need to limit the maximum period for the its exercise. If information about right of withdrawal is not provided, it must be clearly stated that the period o19f its exercise is not calculated until "the correct information is provided". It is possible to eliminate a misunderstanding-possibility by revising the unclear contents of "start of supply" for the period of exercise of the right of withdrawal to be "consumer receipt".
