Abstract
In 2005, Korean government amended Equal Employment Act to add provisions bringing in affirmative action for female workers. The provisions require that employers including public agencies and corporations make and submit affirmative employment plans for female workers. This is not the first affirmative action taken by Korean government. In the middle of 1990, the government set a policy to take affirmative action in the exam for government higher officers. That policy had limited application to government officers and government acts. Then, there was less controversy surrounding its constitutionality. However, amended provisions of Equal Employment Act apply both public and private sectors. Accordingly, it is unclear whether these provisions are constitutional. In my opinion, because of less certainty about constitutionality, Equal Employment Act takes a less radical method to set affirmative action. Despite that, based on the experience from the U.S., current provisions will be effective to improve employment practices and to achieve equal employment opportunities in corporations.
