이 연구는 의과대학에서 인문사회의학 교육이 의학 교육의 한 부분으로 다루어지고 있는 현 시점에서 의료법 교육의 목표와 실천방향 그리고 그 접근방법을 모색해보고 앞으로의 전망을 논의해보는 것을 그 목적으로 한다. 의과대학에서의 의료법 교육의 목표는 ‘도덕적 전문직’으로서의 의사 양성이라는 인문사회의학 교육의 목표와 분절적으로 이해할 수는 없다. 의과대학에서의 의료법 교육은 단순한 인문학적 또는 사회과학적 소양의 증진에 있는 것이 아니라 ‘의사’라는 업(業)과의 ‘직무관련성’이 인정되는 규범적 내용의 이해를 그 핵심으로 한다. 의료가 이미 사회적 하부체계로 편입되어 그에 관한 법체계가 형성되어 있는 현대 사회에서 의사가 관련 법규범의 주요 내용을 인식하고 이해하는 것은 의사로서의 직무를 올바르게 수행함에 있어 필수적인 요건이 된다. 의과대학에서의 의료법 교육은 의사국가고시를 대비하기 위한 보건의약관계 법규에 대한 교육과 일정한 관련성을 맺고 있는 것은 사실이나, 시험 대비를 위한 법규 교육만으로는 본래 인문사회의학 교육이 추구하는 목표나 가치를 충분히 구현할 수는 없다. 따라서 의과대학에서의 의료법 교육에 있어 ‘의료법’은 ‘의료법규’에 한정되는 것이 아니라 이를 넘어서서 ‘의료법학’을 지향하는 것이 되어야 한다. 즉, 의과대학에서의 의료법 교육은 실정 법규의 내용, 즉 ‘법 지식(knowledge)’의 전달에 그쳐서는 아니 되고, 의사로서 의료 현장에서 부딪힐 수 있는 다양한 법적 문제들에 대하여 최소한의 ‘법적 사고를 할 수 있는 능력 내지 방법(legal mind)’을 가르치는 것이어야 한다. 이를 위해 의료윤리 교육과의 통합적 접근방법, 그리고 그 교육 내용을 핵심 내용과 심화 내용을 분류하고, 전자는 필수과목으로 하되, 후자는 선택과목으로 운영하는 단계적 접근방법 등을 모색할 필요가 있다.
Abstract
This article aims to discuss on goals, future directions and approach methods relating to a legal education in medical school, and to reexamine the relation between medical ethics education and law education. The purpose of legal education in medical school has to be understood as a coherent way to nurture the doctors as ethical professionals. The kernel of legal education in medical school is not simply to enhance overall humanitarian understanding but to comprehend the norm that is directly related to their profession as doctors. It is indispensable for doctors to recognize and fully understand legal issues related to medical area considering the fact that medicine has already been constrained by legal system of modern society. It is true that legal education is in part covered by medical regulations education to prepare national examination, but that is not enough to fully achieve the purpose of medical humanities and social science. The legal education should not be limited to medical regulations but broaden to health law as a whole. That is, mere delivery of legal knowledge is not enough. The education should involve learning minimum legal mind to deal with various legal issues as a doctor. In order to make it possible, we have to elaborate integrated approach, and phased approach. One possible measure as phased approach is to classify the law education contents into what is core and advanced. The required courses should consist of core contents such as a concept of medical malpractice, basic medical malpractice cases and legal responsibilities of medical personnel. On the other hand, optional courses should consist of more advanced contents such as burden of proof about medical negligence and causality.
