본 연구에서는 이번 낙태죄에 대한 헌법불합치결정을 중심으로 다양한 측면에서 논의를 했다. 먼저, 이번 결정이 갖는 의미에 대해 간략하게 정리하고, 태아 및 임부의 기본권 보장 영역의 설정을 위해 양 기본권의 상관관계 파악, 현행 낙태죄 규정에 따른 임부의 기본권 침해 여부, 태아 생명권의 제한 가능성 여부 등에 대해 구체적으로 살펴보았다. 이에 대한 내용 정리가 선행되어야 헌법불합치 결정의 의미가 더욱 명확해지고, 그 타당성이 확보되기 때문이다. 다음으로는 최근 자료를 통해 해외 입법례의 특징적인 부분들을 검토했는데, 반복되는 불필요한 언급은 피하고 각국의 특징점을 찾는 것에 비중을 두었다. 그리고 향후 형법에 대한 개정논의 과정에서 포함되어야 할 각 쟁점에 대해 의견을 제시했다. 즉 현행 낙태죄 처벌규정의 개정방향에 대한 입법적 제언을 시작으로 임부의 자기결정권 행사 시기의 명확하고 예측 가능한 기준의 마련, 예상되는 한계점을 최소화하여 실질적이고 현실적인 임부의 자기결정권 행사가 가능토록 보완책 모색, 법이 개정되고 이에 따라 제도와 정책이 마련되겠지만, 허울뿐인 유명무실한 제도가 되지 않도록 실효성을 담보할 수 있는 대안을 제시했다. 그러나 무엇보다 핵심적인 사항은 입법부가 확실하게 중심을 잡고, 다양하고 지속적인 논의의 장을 마련함으로써 각계각층의 견해가 모일 수 있도록 의견 수렴의 매개체로서 그 역할을 다하는 것이다.
Abstract
In this study, I discussed various aspects of the constitutional discordance adjudication of the abortion crime. First, the implications of this decision are summarized. In order to establish the basic rights of the fetus and pregnant women, we examined the correlation, the infringement of the basic rights of the pregnant women, and the possibility of restriction of the life rights of the fetus. This is because the meaning of the constitutional discordance adjudication becomes clearer and its validity is ensured. Next, I examined the characteristic parts of overseas legislation through recent data. I focused on finding characteristic points of each country while avoiding repeated matters. And I commented on each issue to be included in the process of revising the criminal law in the future. In other words, starting from the legislative proposal for the amendment of the current abortion punishment rule, it is necessary to set clear and predictable criteria for the timing of the exercise of self-determination in the pregnancy, to minimize the expected limit. The law has been revised and the system and policy will be prepared accordingly, but I suggested that the alternative should secure effectiveness so that it does not become a obsolete system. But the most important thing is that the legislature should play a central role in ensuring that various opinions can be gathered by providing a forum for discussion.
