Abstract
Artificial intelligence raises privacy concerns in complex and unique ways. Individuals are concerned that their privacy may be compromised while their data is being utilized to develop AI systems, and for organizations, complying with data processing regulations may be more challenging than following traditional privacy rules. Protecting privacy in the AI era has policy objectives related to civil rights, innovation, and the flourishing of human life in liberal democracies, while protecting data subjects' rights and safeguarding against privacy breaches. However, data minimum processing does not always align with data sharing policies, nor does it guarantee safe and ethical use. Prioritizing the consent process in the belief that using original data will lead to better outcomes is not appropriate as a legislative goal for developing unbiased and trustworthy AI systems. Legislation for AI systems and data privacy should reflect the nature of the data generated by the data collection methods, sharing schemes, and inference-drawing algorithms. It is also necessary to clearly establish appropriate conformity assessment and risk assessment criteria for government organizations to develop and deploy AI systems. At the same time, case-by-case assessment guidelines should be developed to reflect the laws of different countries, including the European Union, and global regulations.
