사회갈등해결에서 숙의적 시민참여와 대안적 분쟁해결 접근 비교

본 연구에서는 사회갈등 해결 접근을 평가하기 위한 기준으로 적실성과 효과성을 제시하였고 이 기준에 따라 여러 접근 (관료적 해결, 정치적 결단, 사법적 방법, 대안적 분쟁해결, 숙의적 시민참여)을 평가하였다. 연구 결과를 요약하면 다음과 같다. 첫째, 현재 한국 사회에서 관료적 접근으로는 사회갈등을 해결하는 것이 어려워지고 있고, 그에 따라 정치적 결단과 사법적 방법의 시도가 증가하고 있다. 하지만, 정치적 결단과 사법적 방법을 통해서도 갈등당사자들간 신뢰회복, 사회역량의 성숙, 나아가 갈등예방 효과를 기대할 수 없다. 둘째, 대안적 분쟁해결 방법은 갈등당사자들이 합의하는 경우 갈등을 종결할 수 있고, 당사자들간 신뢰 회복에 유리하다는 장점이 있다. 이 방법은 이해당사자들이 누구인가가 명확한 갈등, 이익을 둘러싼 갈등, 비정부 행위자들간 갈등에 적실하다. 한편, 숙의적 시민참여제도는 갈등해결을 최종 결정하는 것이 아니라는 점에서 한계를 가지지만, 신뢰 회복과 사회역량의 성숙에 기여하는 바가 크다. 이 방법은 이해당사자들의 범위가 불명확한 갈등, 가치를 둘러싼 갈등, 정부가 관여한 갈등에 적용하기 적당하다. 셋째, 한탄강댐 조정활동의 실패는 해당 갈등문제에 적실하지 않은 방법(대안적 분쟁해결 방법)을 잘못 적용한 것에서 기인한 바 크다. 한탄강댐 갈등문제는 정부가 갈등당사자가 되고, 당사자 경계가 불분명한 가치갈등의 성격을 가지기 때문에 숙의적 시민참여 방법을 중심으로 접근했어야 한다. 적실하지 않은 방법을 채택하는 문제는 ‘빠른 갈등 종결’ 효과에 치중할 때 자주 발생한다.
Abstract
This article presents ‘relevancy’ and ‘effectiveness’ as criteria to assess the approaches of social conflict resolution and applies it in recent Korean society. Followings are the findings of this study. First, as it is getting difficult to resolve social conflict through bureaucratic approach, political determination and judicial method are getting popular in stead. However, they could not restore trusts, increase social capacity, and prevent further social conflicts. Second, ADR (Alternative Dispute Resolution) method has following advantages: if all stakeholders come to an agreement, it could resolve conflict completely and restore trust among them. It is relevant to a conflict where the boundary of parties concerned is clear, a conflict of interests, and a conflict among non-governmental actors. Although ‘Deliberative Citizen Participation‘ has some disadvantages (for example, one can not completely resolve conflict by the participation approach), it has several advantages: effects of restoring trust, increasing social capacity, and preventing further social conflicts. It is relevant to a conflict where the boundary of stakeholders is unclear, a conflict of values, a conflict in which governmental actors are concerned. Finally, applying irrelevant approach(ADR) was the main cause of the failure of Hantan-River Dam dispute settlement. Since it was a conflict of values and a conflict where government was concerned and the boundary of stakeholders is unclear, Deliberative Citizen Participation approach would have been more relevant. Applying irrelevant method is more common when one is focused on quick settlement of conflict.
