중국 부동산 경매제도에 대한 연구

이 논문은 중국의 부동산 경매제도의 특징을 분석한다. 이해의 편의를 위해 필요한 경우 한국의 부동산 경매제도와 비교한다. 사회주의 경제체제인 중국의 경매절차는 외양상 한국과 비슷하지만 중국 부동산경매제도는 내용상 한국의 부동산경매제도와는 큰 차이를 보이고 있다. 이 논문의 목적은 중국 부동산 경매제도의 근거법령, 경매당사자, 경매절차 등을 살펴보는 것이다. 이를 통해 중국 부동산 경매제도의 특징이 한국과 어떻게 다른지 중국과 한국의 부동산 경매제도의 차이점을 비교분석한다. 양국의 주요한 차이점을 요약하면, 첫째, 중국의 경매제도의 근거가 되는 법은 존재하나 아직 체계적으로 정비되지 않았다. 둘째, 경매당사자 중에서 중국은 한국과는 달리 경매기업이라는 제도를 두어, 경매기업이 매수인과 법원 사이에서 경매를 담당하고 있다. 셋째, 경매방식으로 한국은 기일입찰방식을 채택하고 있으나, 중국은 호가경매방식을 채택하고 있다. 넷째, 부동산 경매의 공시에 있어 한국은 매각기일의 2주 전까지 공고를 하지만 중국은 매각기일 7일 전에 경매공고를 한다. 그 결과 중국의 경우 일반인들이 경매에 대한 정보를 취득할 수 있는 수단이 제한 받아 아직 일반인들의 경매 참여가 많지 않은 편이다. 다섯째, 경매절차에서 가장 두드러진 차이는 중국의 경우 권리분석과 명도의 위험이 거의 없다는 점이다.
Abstract
The paper provides an analysis of the real estate auction system in China, and comparisons against Korea with examples. Although the procedure of the real estate auction system in China is similar to Korea, its detailed contents are significantly different between two countries. The purpose of this paper is to look the relevant statutory provisions of real estate auction system, parties to auction, auction procedure, etc. The comparative analysis of two countries’real estate auction system makes clear the characteristics on China’s real estate auction system. The differences of two countries system are as follows. Firstly, the relevant statutory provisions of China’s real estate auction system exists, but it still has not been sorted out systematically. Secondly, unlike Korea, the auctioneer which is an enterprise legal person in China advances auction between court and vendee. Thirdly, Sale of immovables shall follow the method of the quoted auction in China, while it shall follow the method of the date auction in Korea. Fourthly, The auctioneer in China shall announce the opening of an auction seven days prior to the date of auction. On the other hand, the court in Korea shall announce the opening of an auction fourteen days prior to the date of auction. Consequently, many ordinary people can't participate in sale of immovables because they are limited to acquire the information of real estate auction in China. Fifthly, the striking characteristics of China’s auction procedure is virtually free from risk of real estate rights analysis and eviction. Since there are no similar researches conducted on this field, this paper initially analyzes the basic materials on the real estate auction system in China. In conclusion, this paper clarifies the contents and characteristics on China’s real estate auction system. It will be very useful to Korean investors in China and researchers on this field.
