Abstract

The essence of local self-governing system are to own decisive power and own responsibility of the resident. In this time, own decisive power of the resident is expressed by the autonomous legislation authority which is established with decision of the local assembly which is composed of the representative of the resident. This article is to succeed the autonomous legislation system and the actual condition investigation of the wide area self-government body which is accomplished at 2008. This article proved the present address of autonomous legislation authority through investigating the autonomous legislation system and the actual condition of the fundamental self-government which is an autonomous unit which gets near the resident. When it summarizes an investigation result, the fundamental self-governing body was exercising an very narrow autonomous legislation authority. This result shows the supplement principle being applied formally. In order guarantees the autonomous legislation authority which is a core element of local self-governing system, the national legislation principle which is related in local self-government must take a triangular position. And reinforcement of self-government by oneself mind function, and must strengthen the autonomous legislation review support system of the central government about autonomous legislation.
