제주특별자치도에서의 환경갈등 해소를 위한 대안적 법제연구

과거 제주지역은 자연재해를 제외하고는 별다른 환경문제가 발생하지 않는 농업지역이었으나 현대에 이르러 비선호시설의 입지, 대규모 개발사업 등을 둘러싸고 지역사회 내에서 많은 갈등이 발생하고 있으며 그러한 갈등이 쉽게 해결되지 못하고 점차 증폭되어가면서 심각한 사회적 문제가 되고 있다. 더욱이 이러한 갈등은 다수의 이해관계인, 복잡한 쟁점, 과학기술적 불확실성의 요소 등을 포함하는 특징으로 인해 전통적인 분쟁해결제도인 소송제도만으로 해결하기에는 한계가 존재한다. 이에 그 동안 전통적인 소송제도를 보완할 수 있는 대안적 분쟁해결제도를 위한 이론적, 학문적 논의가 다양하게 이루어졌고 이를 법제화하려는 노력도 이어졌다. 환경갈등의 해소를 위한 대안적 제도로서 「환경분쟁조정법」이 규정하는 알선, 조정, 재정이 존재한다. 또한 2007년에는 대통령령으로 「공공기관의 갈등 예방과 해결에 관한 규정」이 제정되었다. 이 규정은 중앙행정기관에 적용함을 원칙으로 한다. 지방자치단체는 이 규정과 동일한 취지의 갈등관리제도를 운영할 수 있다. 서울특별시 등 52개 지방자치단체는 「공공기관의 갈등 예방과 해결에 관한 규정」과 유사한 목적과 내용을 가지는 공공갈등의 예방과 해결을 위한 조례를 제정하여 시행하고 있으며 일부 지방자치단체에서는 공공갈등조정관 제도를 시행하고 있다. 그러나 제주특별자치도에는 이러한 조례나 규칙 등 대안적 갈등관리법제가 아직 마련되어 있지 않다. 제주특별자치도의 환경갈등을 해소하기 위하여 갈등해소를 위한 조례의 제정, 구체적인 가이드라인이나 매뉴얼의 마련, 환경갈등 해소를 위한 전문가 양성 및 교육이 이루어져야 할 것이다. 또한 이러한 환경갈등해소 제도의 활용을 위한 사회적 기반도 마련되어야 할 것이다.
Abstract
In the past, Jeju did not have any serious environmental problems, except for natural disasters. However currently, there are many conflicts in Jeju. These conflicts are related to the presence of non-preferred facilities, large-scale development projects, etc. Sometimes they could not be resolved easily. They typically involve many interested parties, complex issues, elements of technological uncertainty. It is difficult to resolve these conflicts only with traditional litigation system. In the meantime, a theoretical discussion for alternative dispute resolution schemes to complement the traditional litigation system was done in various ways. It was also trying to legislate it. As an alternative legal system for resolving environmental conflicts, there are “Environmental Dispute Resolution Act” and “Regulations on conflict prevention and resolution of public institutions” in Korea. 52 municipal councils including Seoul Metropolitan council, enacted ordinances for the prevention and resolution of public conflicts with the purpose and content similar to the “Regulations on conflict prevention and resolution of public institutions”. However, Jeju Special Self-Governing Provincial council has not yet enacted such ordinances. The ordinances for conflict resolution should be enacted in order to resolve the conflict in Jeju Special Self-Governing Province.
