Abstract
The Human Right Ordinance of Jeju Special Self-Governing Province was enacted on October 6, 2015. This paper aims to review the normative effect of the ordinance and to provide some suggestions to improve it. The ordinance was promulgated according to the official process by authoritative domestic government. However, there is no penalty provided in the ordinance. Also, it does not have any legally binding instrument. Even if the administrative actions for promoting human rights often have beneficial effects, they may have adverse effects against companies that cause human rights violations. However, due to limitations on the current legal system, it could not provide specific binding commitments. In the current situation, the Human Right Ordinance can serve to declare policies and provide a basic framework as the first legal norm for the conduct of local level. In order to promote the human rights at the local level, it is important to develop the provisions that can ensure its effectiveness. Second, the characteristics of the province should be reflected in the ordinance. However, it does not reflect those characteristics such as population, economy, environmental situation, and history. Finally, in order to perform an important function in promoting human rights, the ordinance should provide the framework for developing human rights system with specific provisions and concrete guidelines. Prior to this, local government should make special efforts to collect broad and accurate information on the human rights situation of citizens. I hope that the Human Right Ordinance of Jeju Special Self-Governing Province could have actual normative effects through these efforts.
