지역발전을 위한 특구의 유형과 각 유형의 법적 구조 및 그 실태에 관한 비교고찰

광역형 특구인 경제특구와 달리 지역특화발전특구와 같은 지구형 특구는 글로벌 경제체제에서 개방적 경쟁에의 대응력부족으로 어려움을 겪고 있는 지역과 지구의 경쟁력강화방안으로 최근 세계적으로 새롭게 각광받고 있는 제도이다. 미국의 상업활동촉진지구(BID), 일본의 구조개혁특구, 영국의 소외지역특구(SEU) 등이 그 예이다. 새롭게 등장하는 특구들은 후진국이 아닌 선진국에 등장하고 있고 매우 좁은 지구들에 초점을 맞춘다는 점에서 과거 자주 후진국에서 나타났던 경제특구들과는 다른 것이다. 입법자들은 지구형 특구를 설계하고 개선함에 있어서는 외국과 다른 우리나라 지역사회의 실정을 고려하여 재정적 지원조치를 효과적으로 활용할 필요가 있으며 중산층과 저소득층에 대한 접근을 구별하여 특구의 법적 구조를 차별화해야 한다. 다만, 전통적인 읍과 면사무소 소재지 등에 대한 특구정책은 그 동안 경제발전과정에서 소외되었지만 여전히 농어촌사회의 구심적 지위를 유지하면서 관광, 향토특산물 가공 등에서 갖는 특수한 역할을 고려하여 재정적 지원을 포함시켜 접근해야 할 것이다. 이외에도 상주하는 관리기구의 설치, 규제완화조치, 마이크로 커뮤니티 등 다양한 지역경제활성화조치들에 대해 특구정책을 통해 제공가능한 수단들에 포함시켜 지역실정에 적합한 지원이 가능하도록 하여야 할 것이다.
Abstract
This article provides an analysis on types and legal structure of special districts, that focus on local districts, but wider regions. These types of special districts, BIDs of the US, SEU districts of England or Japan’s New Special Zones for Regulatory Reform aim at revitalizing depressed areas, and they are so popular in developed countries, not in developing countries. Korean government has introduced New Special Zones for Regulatory Reform similar to Japan, but suffers from lots of difficulties, and now tries to reform the law. Part I begins by defining a word of a ‘special district’, that focus on not the agency, but the area in Korea, contrary to the US. Part II provides an explanation of types and legal structure of local special districts. Part III distinguishes special districts for low income people from special districts for middle class, and provides an explanation about several instruments, that can be used in legal design for each special district. Part IV explains the special role that small towns, not cities, play in rural areas. In order to overcome the history of long exclusion from Korea’s economic development, these traditional towns need a new special district policy and law, which includes financial assist programs.
