인간다운 생활의 수준에 대한 탐구는 사회보장법 연구의 시작에 해당하는 과제일 뿐만 아니라 사회권의 헌법적 탐구 중에서도 가장 기본적인 문제에 속한다. 인간다운 생활 수준의 보장을 자유롭고 평등한 시민권을 누리기에 가장 적합한 보장수준이라고 이해하는 것도 그러한 이유 때문이다. 그럼에도 불구하고 그에 관한 본격적인 연구 성과는 명확히 찾아보기 어렵다. 또 인간다운 생활은 어떤 생활이고 그 수준은 어디까지인가 하는 질문은 최근의 사회보장의 구조개혁과 관련해서도 일정한 의미를 가지고 있다. 왜냐하면 최근의 사회보장의 경향인 민영화 내지 시장화의 경향 및 저출산 고령화의 현상, 공적 연금제도에 대한 개혁론 등 다양한 측면에서의 새로운 사회보장적 요구는 사회보장의 개혁을 요구하고 있으며, 여기에는 인간다운 생활의 수준의 보장을 적절히 보장할 수 있을지 혹은 그것을 훼손하지는 않는지에 대한 탐구가 선행되어야 하기 때문이다. 인간다운 생활에 대한 기존의 연구는 인간다운 생활의 수준은 확정할 수 있는 것인가? 또 그것은 어느 정도의 수준을 의미하는가에 한정되어 있다. 본 연구에서는 여기서 한 걸음 더 나아가 좀 더 근본적이고도 원리적인 연구를 하고자 하였다. 예컨대 인간다운 생활의 권리에서 상정하고 있는 인간상은 어떤 인간인지를 탐구해 보았다. 이에 대한 결론으로 인간다운 생활을 하는 인간은 자율적 인간, 책임성 있는 인간, 사회와의 관계성 있는 인간임을 확인하였으며, 이를 위하여 각 개인의 잠재능력을 발휘할 수 있도록 국가는 조력하지 않으면 안된다는 점을 확인하였다. 끝으로 기술적인 측면으로서 인간다운 생활을 정하는 행정과정에서의 재량과 그에 대한 통제에 관하여 기술하였다. 여기서는 실체적, 절차적, 정책적 측면에서의 행정재량이 발생할 수 있음과 그에 대한 통제의 방법에 대해 기술하였다.
Abstract
A Study of the life worthy of human beings is not only theme that opens the gateway of social welfare law but also the most basic problem of social rights in constitutional law study. So the guarantee of the standard of life worthy of human beings is understood as the most suitable guarantee standard that enable human beings to liberal and equal citizenship. Nonetheless serious study result of that theme is not founded definitely in Korea. And "What life" is life worthy of human beings? "What human beings" is guaranteed life worthy of human beings? "To what standard" is guaranteed life worthy of human beings? These are not only the most basic qustions of social welfare law, but also have connections with recent social security structural reform because recent social security tendency, privatization and marketizaton of social security, the falling birthrate and the aging of society, public pension reform etc. are background of new social security reform requests, for answer to these requests, fundamental study of life worthy of human beings are gone ahead. What human beings are concepted in the right of life worthy of human beings? Those are autonomous human beings, responsible human beings and human beings who are in the relation of other people, society, other community and nation. the most important thing is human being of relation with nation. That is the mean that the nation guarantes autonomous of human beings and the guarantee of life worthy of human beings do not disturb guarantee of other freedom. And for these, nation assistant human beings to give full play to their basic capability. The next, I describe the administrative discretions and controls to that, that occur in process of decision of a life worthy of human beings. About the controls, in substantial, procedual and political aspect, the most suitable and applicable control methods are proposed.
