사회적 규제는 광범위한 사회적 활동을 포괄하며, 거의 모든 기업ㆍ국민이 사회적 규제의 대상이 된다. 그래서 사회적 규제는 전국적인 효력범위를 가지고 있다. 하지만 사회적 규제가 전국 공통의 획일적 규제적용을 의미하는 것은 아니다. 규제는 그 분야별로 지역적 특수성이 반영되어야 하는 것도 있다. 그렇기 때문에 사회적 규제는 중앙정부와 지방자치단체 간의 긴밀한 협조와 역할분담을 필요로 한다. 사회적 규제는 규제의 형성과정과 집행과정에서 규제담당자들의 협력(협의와 협치)이 요구된다. 이는 사회적 규제형성 단계에서의 거버넌스체계 구축, 규제집행단계에서의 협치적 환류체계의 구축을 통해 가능해질 것이다. 이를 위해 본 연구에서는 중앙정부와 지방자치단체 간의 사전적 규제협의제도의 도입을 제시한다. 다음으로 실효적 환류체계를 갖춘 규제 모니터링제도의 도입을 제시한다. 이 제도들은 지방자치단체와 중앙정부의 거버넌스체계를 통해 실효성 있는 사회적 규제의 운용을 가능하게 할 것으로 예상된다.
Abstract
Social regulation covers a wide range of social activities. So almost all businesses and citizens are subject to social regulation and effects of social regulation extends throughout the country. Even so, social regulation does not mean that only the application of undifferentiated of criteria. Regulation of the sector should reflect a regional specificity in some cases. Because of social regulation need to work closely with the roles between to Regulatory agency(the central government and local governments). The process of formation of regulatory and enforcement cooperation in the social regulation of the regulators is required. This cooperation is in the formative stages of social regulation through the establishment of governance systems and a return current system will become possible. For this purpose, this study suggests the system of ‘ex ante regulation consultation’ in between the central government and the local government is presented. Next, regulatory monitoring system equipped with effective a reflux system proposes the introduction. This systems through the governance system of the local governments and the central government that enables the operation of the effective social regulation is expected.
