국가와 지방자치단체의 빈곤아동 지원법제에 대한 연구 - 영국 및 미국 법제와의 비교를 중심으로 -

이 논문은 아동빈곤의 해결은 실효성 있는 아동복지 정책과 그 집행이라는 문제의식을 가지고 2012년 7월부터 시행되고 있는 「아동의 빈곤예방 및 지원 등에 관한 법률(이하 아동빈곤예방법)」의 제정 과정 및 내용 살펴보았다. 아동빈곤예방법은 아동 가운데 특히 빈곤상황에 놓은 아동을 대상을 하여 구체적인 권리 실현이 가능하도록 지원하는 법률로서의 의미를 갖는다. 특히, 아동 빈곤을 일상적인생활여건과 자원이 결핍하여 사회적·경제적·문화적 불이익을 받는 포괄적인 개념으로 파악하면서 아동이 성장·발달하기 위해 필요한 전반적인 지원이 가능한 토대를 마련하였다. 하지만, 중앙정부와 지방자치단체간의 협력, 재원 조달 등에 있어한계점을 가지고 있는 것으로 파악되었다. 이에 대한 입법적 보완을 위해 아동빈곤예방법 제정 당시 참고한 영국의 Child Poverty Act 2010에 대하여 면밀히 살펴보았으며, 영국은 아동빈곤에 관해 '저소득(Low income)’을 기본적인 판단기준으로 4가지 유형을 정립하고 영국정부 뿐만 아니라 제반 공급체계의 의무를 규정한 것을 도출할 수 있었다. 아동빈곤에 대해 범정부적으로 장기적인 계획을 수립하고 그에 대한 결과를 분석하면서 궁극적인 목표를 달성하고자 하는 입법적인 노력이 있음을 알 수 있었다. 영국 이외에도 최근 아동빈곤에 대한 관심을 가지고 여러 입법적 제안을 하고있는 미국의 사례를 살펴보았다. 아동빈곤감축법(Child Poverty Reduction Act)의 법안, 아동빈곤퇴치법(End Child Poverty Act) 법안, 아동빈곤퇴치를 위한 부모책임법(Parental Accountability for Reducing Child Poverty Act)법안, 아동빈곤감축법(Child Poverty Reduction Act of 2015) 법안을 검토하면서 국세 또는 보조금을 통해 재원마련과 종래 아동복지정책과의 연계성을 도모하여야 하는 필요성에 대한 시사점을 얻을 수 있었다. 복지는 제도의 시행도 중요하지만, 모니터링의 중요성도 매우 크기 때문에 아동빈곤예방법이 실태조사에 관한 규정을 신설하여 빈곤아동의 현황을 분석하도록 하는 것도 유의미하지만, 실태조사를 활용하여 빈곤아동에 대한 지원 이후의 모니터링을 통한 복지자원의 효율적 활용, 아동 맞춤형 서비스의 제공도 함께 고려해야할 것으로 보인다.
Abstract
The purpose of the ACT ON PREVENTION OF CHILD POVERTY, SUPPORT OF CHILDREN, ETC(the Act on the Prevention of Child Poverty), which has been enforced from July 2012, is to prepare an institutional basis on which impoverished children can grow into healthy members of society without being alienated or discriminated in the aspects of welfare, education, culture, etc. This paper examines the process and contents of the Act on the Prevention of Child Poverty with the awareness of the issue of effective child welfare policy and its enforcement The Act on the Prevention of Child Poverty has the meaning as a law to support the realization of specific rights of children, especially children in poverty situations. Especially, in this act "child poverty" has a very comprehensive meaning., that is a state of poverty in which a child is disadvantaged socially, economically, and culturally due to inadequate daily living conditions and lack of resources. This has made it possible to provide overall support for child poverty. However, it is recognized that there is a limit in cooperation between the central government and local governments and financing. In order to supplement the legislation, the Child Poverty Act 2010, which was referred to at the time of enactment of the Act on the Prevention of Child Poverty, was closely examined. The UK established specific standards for child poverty and defined the obligations of the UK government as well as the supply system . In addition to the United Kingdom, recent examples of US legislative proposals with an interest in child poverty have provided implications for the need to link funding and traditional child welfare policies. Although the implementation of the welfare system is also important, it is also important to monitor the status of poverty children. Efficient utilization of welfare resources and provision of child-tailored services can be realized after monitoring.
