기술에 대한 국가의존도가 높아질수록 산업보안 및 산업기밀유출 대응에 대한 중요성은 커지고 있고 영국도마찬가지이다. 본 연구에서는 경제안보 차원의 산업보안 관련 영국의 대응조직과 새롭게 도입된 국가안보법(National Security Act 2023)을 검토하여 시사점을 도출하고자 하였다. 이 법은 한 세기 동안의 스파이법 개혁 중 가장 중요한것으로 언급되고 있으며, 제1차 세계대전 전후 독일 스파이로 인한 위협을 막기 위해 마련된 공공비밀법(Official Secrets Acts)을 현대화한 것으로 해석된다. 이 법은 국가안보, 국민안전, 그리고 외국 국가의 적대적 활동으로부터영국의 중요 이익을 보호하기 위한 새로운 조치들을 담고 있고, 특히 경찰 등 법집행기관의 수사권한과 역량을제고하고, 관련된 행위를 범죄화하였다는 의미를 지닌다. 도출된 시사점은 크게 세 가지로, 첫째, 효율적 거버넌스체계이다. 둘째, 기존의 법률보다 더 넓은 지역적 및 인적 관할을 인정하고 있어, 법률의 적용범위 확대로 현대의스파이행위를 포섭할 수 있다. 셋째, 형사처벌을 하는 것이 기본이지만, 형사적 처벌이 어려울 경우에 대비하여비형사사법적 제재 수단을 마련하였다. 관련하여 국내 제도 및 상황과 비교하여 도입 시 고려사항 등을 검토하였다.
Abstract
As national reliance on technology increases, the importance of industrial security and countering industrial espionage is growing, and the UK is no exception. This study reviews the UK's organizational response to industrial security from an economic security perspective and examines the newly introduced National Security Act 2023. This Act is mentioned as the most significant reform of spy laws in a century and is seen as a modernization of the Official Secrets Acts, which were originally introduced to counter the threat of German spies before and after World War I. The law includes new measures to protect Britain’s critical interests from national security threats, public safety, and hostile activities of foreign states, enhancing investigative powers and capabilities of law enforcement agencies like the police, and criminalizing related activities. The implications derived are threefold: first, the establishment of an efficient governance system; second, recognizing a broader territorial and personal jurisdiction than existing laws, which allows for encompassing modern spying activities; and third, focusing on criminal sanctions but also preparing non-criminal judicial sanctions for cases where criminal punishment may be difficult. The study also considers what domestic systems and situations should be taken into account if adopting similar measures.
