Abstract
This paper examines the recent legislative developments in Japan concerning sexual offenses, with a focus on the 2017 and 2023 amendments to the Penal Code. The 2017 revision marked a significant shift by renaming the long-standing offense of “rape” (in use since 1907) to “forced sexual intercourse” and by transforming sexual offenses from crimes requiring a victim’s complaint to non-complaint crimes. The 2023 amendment introduced further substantial changes. Most notably, the chapter title was revised to “Crimes of Obscenity, Non-Consensual Intercourse, and Bigamy,” and the terminology of core sexual offenses was altered to reflect a consent-based framework— replacing “forced” with “non-consensual.” Offenses previously categorized as forced sexual intercourse or forced indecent acts were redefined as non-consensual intercourse and non-consensual indecent acts, respectively. Related offenses, including quasi-forced acts and those involving pseudo-sexual conduct, were consolidated under this new framework. The amended provisions also expanded criminal liability and increased statutory penalties to strengthen the protection of minors under the age of 16. Notably, the law now explicitly recognizes the possibility of sexual offenses within marriage and raises the age threshold for certain offenses from under 13 to under 16. In addition, sexual acts involving persons aged 13 to 15 are now punishable if the perpetrator is at least five years older. Newly criminalized conduct includes soliciting meetings or transmitting sexual imagery to minors under 16 through coercion, deceit, or inducement. Furthermore, Japan enacted a special law introducing provisions equivalent to Korea’s offense of illegal filming using cameras or similar devices. Compared with Korea, several structural differences remain: Japanese law incorporates sexual offenses infringing both social and individual legal interests within the Penal Code, lacks a separate statute such as Korea’s Act on the Punishment of Sexual Crimes, and defines the scope of sexual offenses more narrowly. Interpretive differences also persist in judicial precedents regarding the nature of sexual crimes.
