이 연구의 목적은 한국에서 환경오염이 본격적으로 대두하고 문제시된 1970년대에 주목하며 ‘비가시화’한 피해와 폭력, 재난의 문제를 ‘가시화’하는 데 있다. 특히 이 연구는 환경오염이 두드러진 지역 주민의 반공해운동을 조명하는 ‘공해의 민중사’를 지향한다. 한국의 환경오염 문제는 1960년대부터 두드러져서 1970년대 ‘재난’ 상황으로 확대되었다. 오염은 대도시 지역과 공업단지, 자원 채굴 지역을 중심으로 심해졌다. 오염지역 주민들은 공해 유발 업체를 찾아가 항의하고, 행정기관에 해결을 요청하는 진정 활동을 벌였다. 이러한 반공해활동의 증가에 대응하여 정부는 공해방지법 개정과 환경보전법 제정 등 제도를 개선했다. 그러나 제도 개선에도 불구하고 공해방지 행정은 환경오염의 심화를 해소하는 데 한계를 보였다. 이에 피해 주민들은 생존권 확보를 위해 공해소송을 제기했다. 공해소송은 사법계의 인식 변화와 함께 점차 피해배상이 강화하는 방향으로 바뀌었다. 그러나 손해배상 위주의 공해소송은 사후 구제 조치일뿐, 신체장애와 지역 공동체 해체, 생태계 파괴를 되돌리는 방식은 아니었다.
Abstract
The purpose of this study is to “make visible” the “invisible” problems of damage, violence, and disaster by focusing on the 1970s when environmental pollution became an emerging and problematic issue in South Korea. In particular, this study aims at a “people’s history of pollution” that sheds light on the anti-pollution movements of residents in areas where pollution was severe. The problem of environmental pollution in South Korea became prominent in the 1960s and escalated to a “disaster” situation in the 1970s. Pollution has intensified mainly in metropolitan areas, industrial complexes, and resource extraction areas such as mining. Residents of polluted areas protested against the polluters and organized petition activities to request administrative agencies to resolve the problem. In response to this increase in anti-pollution activities, the government had improved the system, including revising the Pollution Prevention Act and enacting the Environmental Conservation Act. However, despite institutional improvements, pollution prevention administration showed limitations in resolving the worsening environmental pollution. In response, affected residents filed pollution lawsuits to secure their right to survive. Pollution lawsuits have gradually shifted toward strengthening compensation for damages along with changes in the judicial community’s perception. However, pollution lawsuits focusing on damages were only ex post facto relief measures, not a way to reverse physical disability, disintegration of local communities, and destruction of the ecosystem.
