지난 2012년 1월 협동조합기본법(이하 기본법)이 발효되었다. 이 무렵 기본법의 실효성 제고를 위한 논의가 활발하였고, 이와 관련한 논문들도 많이 나왔다. 예컨대 기존의 협동조합 관련법에서 본사회적협동조합의 문제점과 외국의 입법사례를 중심으로 한 사회적협동조합의 법률적 문제점을 다룬 논문이 발표되었다. 이 두 편의 논문은 협동조합의 역사적, 현실적, 미래지향적 관점에서 기본법의 문제점을 다룬 것이다. 이제 기본법이 제정된 지 5년이 지났고, 그 동안 8차례에 걸쳐 수･개정을경험하였다. 이 과정에서 위의 두 논문에서 논의되었던 문제점들이 어떻게 해소되었는지를 알아보고자 한다. 특히 기본법이 당초에 의도하였던 것, 즉 우리나라 협동조합의 안정성과 건전성 제고를위한 기본법의 입법취지가 어떻게 구체화되고 있는지를 이 논문에서 살펴보고자 한다.
Abstract
The Framework Act on cooperatives has been enacted since January 2012. Around this time, there were many discussions about enhancing the effects of the framework act, and several papers regarding the topic have also been published, such as “Problems of Social Cooperatives from the Perspective of Cooperative Basic Law” and “The Problems of the Legal Provisions for Social Cooperatives from the Perspective of Foreign Legislations”. This two papers revolve around the problems of the framework act from the perspectives of the historical, realistic, and forward-looking tasks of the cooperative. Now, five years have passed since the enactment of the Framework Act, and in this time, the Framework Act has been revised eight times. This study offers a motive to review how those problems debated in the two papers above have been solved. The paper aims to hold fast to the original purpose of the Framework Act in order to enhance stability and soundness of the cooperative society in Korea
