목적 본 연구는 태권도의 법적 국기화 과정에 내재된 정치적·사회적 배경과 입법 과정의 주요 쟁점을 분석하여, 태권도 법제화가 국가 정체성 형성에 미친 사회적 함의를 밝히고자 하였다. 방법 본 연구는 관련 법령, 정책 문서, 국회 회의록 등을 중심으로 문헌연구를 수행하였다. 결과 태권도는 법제화 이전부터 국가적 상징성을 지닌 문화자산이었으나, 법적 보호는 미비하였다. 2012년 첫 입법 시도는 국가상징물 법안의 일부로 논의되었으나 무산되었고, 2018년 「태권도진흥법」 개정을 통해 공식 국기로 지정되었다. 국기 태권도로의 법제화는 첫째, 국가 정체성을 강화하고 법적 보호 체계를 구축하는 과정에서 이루어졌다. 둘째, 국제 스포츠 경쟁력 확보 및 일본 가라테의 올림픽 정식 종목 채택에 대응하는 전략적 논리가 주요 논거로 작용하였다. 셋째, 태권도의 국가주의적 성격과 국제 스포츠로서의 개방성 간의 균형 유지가 중요한 과제로 부각되었다. 넷째, 법제화 이후 태권도는 국가 브랜드 자산으로서 활용될 가능성이 확대되었으나, 스포츠의 자율성과 창의성을 저해하지 않도록 법적·정책적 조정이 요구되며, 국제 스포츠 환경과의 정합성을 고려한 후속 연구가 필요함이 제안되었다. 결론 본 연구는 태권도 법제화를 스포츠 정책 차원을 넘어 국가 정체성과 연계하여 분석했다는 점에서 의의를 갖는다. 향후 법제화가 태권도의 국제적 개방성을 유지하면서 지속 가능한 정책적 효과를 거두기 위한 논의가 필요하다.
Abstract
Purpose This study analyzes the political and social contexts embedded within the legislative process that officially designated Taekwondo as Korea's national martial art, critically examining key issues raised during parliamentary debates. It further explores the broader social implications of Taekwondo’s legalization, particularly regarding its influence on the construction of national identity. Method A literature review was conducted based on relevant laws, policy documents, and National Assembly records. Results First, the legalization of Taekwondo was a process that strengthened national identity while establishing a legal framework for its protection and promotion. Second, securing international sports competitiveness and responding to the inclusion of Japanese Karate as an official Olympic sport played a significant role in the legalization process. Third, the tension between Taekwondo’s nationalistic symbolism and its openness as a global sport emerged as a critical issue, requiring a balanced policy approach. Fourth, after legalization, Taekwondo’s potential as a cultural and diplomatic asset was expanded, emphasizing the need for strategic policies that maintain its autonomy and foster international collaboration. Conclusion This study contributes to the academic discourse by analyzing Taekwondo legalization beyond sports policy, positioning it within the framework of national identity formation. Future research should explore ways to sustain Taekwondo’s global presence while ensuring that legal and institutional measures support both its cultural heritage and its status as an international sport.
