경제육전의 성립 배경과 편찬자 조준의 주례 인식

이 논문은 『경제육전』에 대해 고찰한 글이다. 주지하다시피 『경제육전』은 태조 6년 도평의사사(都評議使司)의 부속기관인 검상조례사(檢詳條例司)에서 조준(趙浚)의 책임 하에 편찬된 조선 최초의 법전으로 흔히 『경제원육전(經濟元六典)』 또는 『원육전(元六典)』이라고 한다. 그러나 이 법전은 시행된 지 얼마 되지 않아 곧 바로 개찬작업이 추진되어, 『속육전(續六典)』, 『경제육전원집상절(經濟六典元集詳節)』, 『경제육전원전(經濟六典元典)』, 『경제육전속전(經濟六典續典)』, 『신속육전(新續六典)』 등으로 개찬(改撰)되어 반포하였고, 편찬 책임자에 따라 조준육전(趙浚六典)⋅하륜육전(河崙六典)⋅이직육전(李稷六典)⋅황희육전(黃喜六典) 등으로 불리기도 하였다. 그러나 『경제육전』은 오늘날 전해지지 않으므로 체재와 내용을 정확히 알 수 없지만, 『조선왕조실록』에 직접 또는 간접으로 인용된 부분이 적지 않은 것으로 보아, 이전⋅호전⋅예전⋅병전⋅형전⋅공전의 육전(六典)과 각 전마다 여러 강목(綱目)으로 나누어져 있었음을 알 수 있다. 이를 복원한 책으로 전봉덕인 수습한 『경제육전습유(經濟六典拾遺)』(아세아문화사, 1989)과 연세대학교 국학연구원에서 편한 『경제육전집록(經濟六典輯錄)』(신서원, 2018)이 있다. 특히 『경제육전』 편찬 책임자인 조준(趙浚)은 <진시무소(陳時務疏)>에서 6부의 중요성에 대해 강조했고, 백관(百官)의 근본인 6부가 정사(政事)가 나오는 곳이라 하여, 『주례』의 육관(六官)제도를 재현시키고자 노력하였다.
Abstract
This paper is a study of the Six Codes of Governance. As everyone knows, the Six Codes of Governance is the first law of Joseon that was compiled at Geomsangjoryesa (檢詳條例司: office in charge of legislation), an affiliate of the Dopyeongeuisasa (都評議使司: supreme council), under the responsibility of Jo Jun (趙浚) in the 6th year of the reign of king Taejo. It is also often referred to as Basic Six Codes of Governance (經濟元六典) or Basic Six Codes (元六典), However, soon after this code was enforced, the correction work was carried out immediately and promulgated as Amended Six Codes (續六典), Detailed Collection of Six Codes of Governance (經濟六典元集詳節), Original Text of Six Codes of Governance (經濟六典元典), Text of Amendment of Six Codes of Governance (經濟六典續典), New Amended Six Codes (新續六典), etc. And according the person in charge of the compilation is was referred as Six Codes of Jo Jun (趙浚六典)⋅Six Codes of Ha Ryun (河崙六典)⋅Six Codes of Lee Jik (李稷六典)⋅Six Codes of Hwang Hui (黃喜六典), etc. However, since the Six Codes of Governance is not communicated today, its format and content are not known exactly. But according to many direct or indirect citations in the Annals of the Joseon Dynasty, we may know that it was separated in Six Codes (六典); Code of Administration of Personnel, Code of Taxation, Code of Rites, Code of Military Affairs, Code of Criminal Law, Code of Public Works and each code was classified in several articles (綱目). The Addendum of Six Codes of Governance (經濟六典拾遺, Asea Culture Publisher, 1989) collected by Jeon Bong-deok and the Collection of Six Codes of Governance published by the National Studies of Yonsei University (Sinseowon, 2018) are the restorations of the Six Codes. In particular, Jo Jun (趙浚), who was in charge of compilation of the Six Codes of Governance, emphasizes the importance of the Six Divisions in his comments of "JishiMuso (陳時務疏)", and tried to restore the system of Six Ministries (六官) of the Rites of Zhou saying that they are foundation of all government officials and where the political affairs come from.
